Thank you for joining us in the month of january and talking about the monster new tax law and how it impacts non-profits twenty eighteen. Um, what? Just for the years of the details? What? What? What? What have you seen in terms of non-profits reaction community reaction to the fact? Well, i think monstrous wasn’t a bad term. Teo described from the perspective of non-profits i think overwhelmingly non-profits leaders who are kind of aware of all of the details provisions that may affect them think it’s a really terrible teo that’s blackbaud either, in some cases, a lack of understanding of what non-profits charities duitz for the country and in some cases, just think that there’s a lack of care, but sadly, it’s not a very good bill and non-profits me to be aware of what? What about them? Okay, uh, let me explain. Listen, if you were working on oddly rigged system, were going through my phone so there may be some delays. Naralo echoes so bear with us there. I want to get this done miles. Jean and i are in the studio. Are available. And you need to ask you if you could remember, speak up a little bit louder than usual. Okay, well, okay. Thanks very much. Um, yeah. Uh, you you believe the conventional and widespread with belief that most of his tax bill is benefiting the wealthy one percent or one tenth of one percent. Yeah, i’m kind of in line with that. That frame of thought that ultimately the richest one percent will end up with by far the majority of the benefits of the tax cuts. And i heard someone. You’re the richest one tenth of one percent are gonna benefit from about sixty percent of the benefits of the tax cut that comes from robert ray’s shut in an article published by newsweek overviewing week early in january. So this is going to be the expected by twenty, twenty seven. A lot of the benefits that cruise teo little income and even lower income individuals made this here. There’s some temporary, uh, deductions and carrots that are given out, if you will, to make it seem like they’re getting to benefit from it, at least initially. And then those disappear. And by the way and deficit get larger there’s going to be a spending cut which made the that’s the social security, medicare and medicaid. I believe the republican congress is there in talking about that let’s call ryan and decrease spending on a social safety nets will increase the needs. Of course, charitable services, the decrease spending from the government and the government supplies about one third of the revenues for charity, so they get their job done through charities by e-giving grass and contact public services that decreased spend spending will mean that charities have less money to address ever increasing metoo duitz a bad results all the way around. Remind me what we talked about in the depths of the recession. In that case, individual giving head declined because unemployment was so high and because unemployment was so high the need, especially in the social services sector, were vastly increasing. Exactly that’s the problem with doing the same thing is that the cause of it is the cause of the individual e-giving decline is, uh, anticipated decline is different. All right, so what do you think we see in terms of brovey fund-raising and how it’s going to be impact, by the way? The send out the increase in the standard deduction, talk us through that. So, sure, but one of the big provisions that that affects everybody is that going to be a doubling of the standard in-kind almost doubling of this from about sixty three hundred fifty dollars to twelve thousand dollars for individuals and double that for married couples. For some people, they would say, you know, we’re getting a bigger deductions, you always taken the standard deduction, and that will seem great, although that’s just temporary, but there are a lot of potential deductions that have gone away, and that maybe means that a lot of people will actually end up paying more in taxes and the impact specifically the charities is that by doubling the standard deduction roughly, you know, thirty percent of taxpayers were ableto itemize their deductions, and only ida miters itemizers would get the benefit of the charitable contribution instructions, because that is one of the itemized deductions that are allowed, but from thirty percent of tax cares itemizing deductions once you double the standard deduction, it will only mean that a thousand five to six percent of taxpayers will now itemize or get the benefits of speeding says the level of the standard deduction by itemizing so basically, what you’re saying now is from thirty percent of the population that could have benefitted tax wise from a charitable contribution deductions lax here this year and going forward because this is already it’s, not a bill anymore. This is the law’s going forward, only about five percent of taxpayers can actually get a deduction for charitable contributions that that is meaningful in any way, so that goes into the so the estimate is that only about five percent of taxpayers will itemize going forward. Yeah, i think it’s about five stick percent going forward is that you going to be subject to some of something that happened, including with state taxes and some states trying to react to all of this as well and creating different measures that’s really hard to really get it, just sort of based on on current conventions, the joint committee on taxation of everyone you know from from the federal government believes that it’s going to be about six percent, five percent of taxpayers that are going to itemize from now on, all right and that’s down from, he said. From thirty percent historical yeah, so i thinking rough numbers are in ron numbers. I think we’re going from about forty six million taxpayers who itemized in two thousand seventeen will go down to less than thirteen on dh that dejected to result in twelve to twenty billion dollars per year, less charitable giving a credible e-giving is tied in part tax benefits. Now a lot of people don’t have tax benefits is their main reasons for giving but it’s fundamentally expect how much leftover incomes have, yeah does play a part in some people’s decisionmaking twelve to twenty billion dollars per year, again from the joint committee on taxation, and they’re estimating that’s going to cost two hundred twenty thousand two hundred sixty four thousand non-profit jobs lost, so okay, zoho all right, i hate to break it there, but what? We need to, um, let’s, pick it up right where we are right now, we need to take a break record they’ve got another testimonials quote, this is my first year, and we are a growing non-profits weinger gps was completely attentive and gave the impression that they were right next door and handling our review engagement even. Let’s, let’s, continue where we are from. Where? From where we are. All right. Those are some pretty dismal sounding numbers now. Okay. You mentioned that charitable are with charitable deductions. Is not there is a lot of evidence that that that’s not the main reason that lots of people give because they get a child abduction. It’s because of their love of the world, yeah, you know. And i think that’s going to be the main reason why people give but there’s the entire industries, including the plan e-giving industry, is, you know very well that that that really considered tax benefits is part of the equation, and it might not impact what who they did, too. But it might impact how much they give. Yeah, now i know it is. It is a factor you all through this in other other changes that have come in the twenty years since i’m doing playing e-giving. I’ve always just stayed with the belief that taxes aren’t the main motivation. Yeah, i agree. Not the main motivations that we’re not seeing a reduction of, you know, fifty per cent of charitable chiming in it’s going to be more expensive of single digit Numbers maybe 42:5 percent production is in charitable giving, but again, that amounts to twelve, twenty billion dollars per year around two hundred twenty thousand one hundred sixty four thousand jobs latto because of that and on top of it, only job friends, yes. And that’s that’s really? I haven’t heard that member. Yeah, heard the iter dollar nasco hadn’t heard the job. I’m sorry. I’m sorry. Go ahead. Yeah. So on top of that, we’ve got the other issues, you know, which is a kind e-giving issues well and that’s the state tax exemption durney so this affected very wealthy, but these state taxes being doubled up to eleven point two million dollars for an individual. And basically, this means that if you pass away and you have more than eleven twenty million dollars, you’ll have to take a very, very heavy a state tax to the government. Now it’s the limit before with half of that about five and a half million dollars to take, but now, going up to it’s doubling, which means again instead of e-giving charity people could give to their family members and said, and that may be a consideration for many of the wealthy were announced it’s going to be shielded by this this hyre state tax extension, and that again, is estimated to cost another four billion dollars for a year in charitable giving, so in percentage numbers of overall charitable e-giving again, we’re talking pretty small overall, but the impact of five percent let’s say e-giving reduction of percent translates to a lot of things that cherry’s can no longer. Yeah, now i hear you’re pounds let’s go back to that deduction. It sounds like this younger, sorry deduction increase the standard deduction increase. It sounds like this is going to be making potentially major donors maur important on more of a focused area than saying younger and, most likely, smaller donors. More modest owners who will no longer be able tio teo take the deduction claim the charitable deductions that but that made the donor’s become to the outside, even greater, even more selling in focus because they didn’t want to be more likely to be able to. Profit from the charitable deduction and which which you know, that charitable deductions reduces the cost of a gift because you’re getting your saving money in taxes, right? Precisely. And we’ve actually been seeing that trendy that even before these new laws and that they have to do with the widening income gap er, or wealth down that exists. So in two thousand fifteen, twenty four percent of taxpayers reported that they had made a charitable gift in their returns, according tto, not analysis of the irish state a decade earlier, so in two thousand five, that was thirty two, thirty one percent. There was already a reduction from thirty two, thirty one percent of taxpayers reporting charitable give twenty four percent reporting charitable give before this tax latto and basically it is because some of the lower middle income people just have less full income than they used to have, and they need to be needed to divide. And so this is going to be doing the same thing it’s not going to impact the wealthy so much unfavorably because they can still get higher than the standard deduction, not for low and middle income people, the increased defended. Deductions might seem like a good thing. They might be able to take more off than the use of the benefits will hooted. And there won’t be the value of making a charitable gift anymore. So the question will be is with that extra income will they make a charitable gift the middle income so our incomes or will they feel that this is unstable? Particularly because this is only a limited or temporary? A doubling of the standard deductions. You will go back to normal after a few years. So that’s that’s kind of the quest? Yeah, and historically, when charitable giving has it like it did in during the great recession. Andan tax laws, tax law changes before then it’s been like three years or so three to four years for charitable giving to ride back to the level it had game before the events that causes according to our country’s history of giving always does rebound. But there have been, like a four year, three, four years, so historically historically it has rebound. It’s that place out here too. Time you mentioned some changes to deductions. That’s good actually result in a loss for individuals, can you? Can you flush out a couple of those? Bilich well, i think what’s happening for for individuals. The idea was generally, the simplified says sort of deductions, but now interpreting it is actually gotten more complicated. So a couple of things is, is there’s no deductions anymore for state and local taxes on a limitation on the deduction for mortgages? First, individuals were coming from high state tax states like new york and california, jersey, massachusetts and connecticut, particularly those with high real estate values and hyre local and state taxes that the double ramming their right so they’re not going to get that deduction on the federal income tax insurance anymore, so if they were paying a lot in those taxes, are getting a big mortgage interest deduction because they have a high mortgage boy? Is that doubling the sanders defections? It may not be so it you know, that may not be enough to offset which may not be enough to offset what they’re losing. Yeah, now, now the mortgage interest deduction was cast right with ten thousand dollars. I’m not completely familiar with the i think what happens is it doesn’t no longer applied to kind of what we call the second mortgage, but it it implies the mortgage for which you purchased you’re home. And i believe lim wass and i’m trying to think it was mortgaged about five hundred thousand or a million dollars under the house from senate till they were slightly different. I’m not okay. That’s all right, all right. Wait. You still have that production, but its kapin its value has been reduced. Correct. Okay, okay. On oneaccord teo. Yes. Definitely going to impact homeowners with high mortgage is especially in new york and california teachers, right? Right. Okay. And also you’re point about state local factories no longer no longer deductible. And that hurt people. Pre-tax. Yeah, and the ten thousand dollars that you mentioned is actually the property tax deduction that you formally take. And that would be captain. Ten thousand starts before i was talking about the mortgage. Oh, i confused, too. All right. Thank you for keeping me straight. All right. I see. I complete things. Okay. Sorry about that. It’s complicated. Still hopes we understand. All right, but you know, it’s. Okay. Um other e-giving e-giving backto non-profits there’s. Been a change to the unrelated business income tax? Sure. So that’s that’s kind of. Ah, more what’s. A little simple to understand. So if you have unrelated business income and it’s taxable, and you’ve got one trader business that’s making a profit and it’s unrelated against those you’re supposed to take cubine or unrelated business income tax on it. But you had another trader business that’s also isolated, but that was that was incurring a lot. You used to be ableto officer of the law from one unrelated state of business against the profits of the possible i’m related. Yeah, that’s, good that’s what investors were allowed to do? They’re allowed to offset capital losses. The world turned their lives off capital gains capital losses, right? So that’s basically is what you’re doing here. Although it’s income rather than send your offsetting, you know, one one area business with another areas business because it’s the same taxi fare that we’re talking. But that’s no longer the case can wait. Put them in silos. So if you’ve got a game in one business that change, you know the taxes. If you have a lost another unrelated business, you might be ableto off that gains in another year from that business alone that was completed. Buy a load out. You’re different. Unrelated. Okay, on there are increasing numbers of non-profits who are engaged in activities that, you know, they they count on, uh, unrelated business thing comes, uh, all right, a lot of pressure on him now, especially with less charitable giving and lessons for charitable giving more non-profits they’re looking for a dink ventures, and some of that will be unrelated. We’re not talking about related income, so it’s, if the activity is related to further a year charitable purpose and you don’t wear the profits just if the activity itself, even if it made no money related, you’re terrible service don’t attack if you do happen to get a part, okay, i understand. Um oh, if you’re okay. So let’s talk about the attacks on endowments of colleges. Yes. So that’s that’s going to be an interesting one, but it only affect very few colleges. I think they’re only going to impact twenty seven colleges and universities. So this was after much haggling between the senate and houses and lobbyists, obviously different colleges and universities. Oh, one point four percent excise, but it is important because now our policy for tax exempt organizations with they should be paying taxes on their income and all. Of a sudden now we’re paying for your college and universities and big yeah, okay, you’re going to wait for it a reversal of an important principle, right? And i guess the danger is that this is a slippery slope i don’t hey, if we can, if we can do it with big colleges and universities, what about smaller colleges universities? What about the charity let’s? Attack them as well? It has been a trend in that on the state level, two of looking for property tax on dh things called highlights, which are krauz payments in lieu of taxes that states they’re trying to charge tax exempt organizations looking for more income from tax accents, and obviously, that that diminishes with charities content to be able to do because they’re gonna have less income because there’s enough today, those pilots are justified because the charitable entity is consuming services of the town but not paying nothing local property taxes, right? That’s the justification that that some room that they again with very well right now they’re frauds get say, well, even if they’re not using the service. Finally, finally, if i were defective, buy-in altum uh, unfortunately, you’ve got another new excise tax. Also, talk about yes, there is there is there enough number of excise taxes, but one that again applies to stake non-profits is on excise tax on compensation of more than one million dollars. Uh, which only a prize. You’re five highest employees and doctors and medical professionals sort of exempted from this, but it doesn’t apply to excess parachute kayman which are kind of seven big severance packages, so it’ll be attacked with corporate rate and again, most for most of your listeners, perhaps almost ology listening longfield anything to them other than the policy of federal government looking to get more more tax money from non-profits on, they’re looking for ways to do that and course, they’re going to get the big ones first. But what? How houses that people down so twenty one percent napor pre-tax rate on compensation of more than million dollars state your five highest employees for tax exempt organization for charity? Well, i wanted to spend time on the excise taxes that only apply at the highest levels of the charitable community because of what he said on what i said earlier hutchisson erosion is brilliant in the national front is the destruction of a longstanding principle in this in the federal tax code, that’s non-profits charitable organizations don’t pay tax, they’re a tax exempt, and now you’ve way are with things the destruction of that principle, and i i think it was it was worth standing up for before it’s still worth standing up for even though the battle the battle has been long, hopefully the war will not be lost, but this is something that is reversible, but as it stands now, we’ve seen that defamation of a long standing three people in this in our federal tax code. Yeah, so it’s a double edged attack and so well put what you said, honey, but it’s a double its attack where authorities are going to get less money, governments are goingto fundchat ortiz last, you’re going to have to have a spending cuts in orderto fund that deficit has created bythe new ac on and then at the same time they’re going to actually tax tax exempt organizations now where they had not done so the floor so it really is a double yeah, onda geun, the principal. Even if you’re not, you’re your organization is not impacted slippery for jean talk about it. It’s at the highest levels now of the non toxic community, but in a couple of years or the next tax code iterations, it could be the midsize organization. Then we could be looking at community colleges so you know, principles that were standing for on dure point well taken about there also being a loss of revenues and that that impact a cross section of non-profits from the smallest to the largest revenue decrease. All right, gene let’s, take let’s, take a break and we’ll come back. We’ll talk about the things that weren’t included, and then you also have some predictions for twenty eighteen and what you think this is gonna lead to? What the field guide is something you do to translate the data that you already has into of active inside that are going to help you in your own mostly fund-raising strategy you’re acting on your data and you know you’re not you’re not stuck in overwhelmed and paralyzed. Some people say, because reports being nothing, you got the fancy reports, but if you don’t know howto act on the data that no, no values pursuant has taken what they’ve learned from working with lots of big organizations, and they boiled it down to basic principle to help you on the small and midsize level follow-up you may have heard rumors too effective big non-profit ideas for the other ninety five percent that’s what we’re talking about that’s what the field god is all about, you know that data? All right, i am going to actually abandon the live listen love podcast fund-raising osili affection, success to say you know that they are going out to use which category you fit in and the reason on contamination my my my love and my pleasantries in my affections because jean and i have so much to cover with. The new tax laws. So i want to get right back into it, okay? James, um, let’s, let’s. Talk about what? The things that could’ve been worse. There are some things that weren’t included. Yes. So the thing i think for her non-profits that was not included that was, uh, in previous iterations of the filthy became a law that was the repeal or the weakening of the johnson amendment. And the johnson amendment is essentially the provision under five a one in three that prohibits charities from engaging in election hearing that is spending their resource is endorsing or closing kennedy with latto so it’s really made charities kind of non partisan in that matter is that they were not engaged, are not able to engage in election area, right? And this was not included. Okay, i know that charitable community is divided on this. Uh, was that was one of the proposal just related to religious organizations. What started out that way on dh? It was trained as a free speech issue. So they there those who had promoted repealing or weakening the johnson amendment to allow for election hearing. We’re really kind of the major’s big evangelical churches. I wanted to fund campaigns basically, um, on and so on by taking away the prohibition o r by taking away that prohibition against election neary they could do that. But, um, it’s really was a weak argument to say that there was a constitutional space for a tax exempt organization to be able to engage in an election year, and certainly churches are open to engage in election hearing and half free speech rights, but for the privilege of past exemptions that’s something that charities give up on, but the general idea is and remember that one third of the revenues they’re coming from the government way don’t really want to spend public funds to fund campaign. We want them to be spent on their charitable purpose and opening it up or even weakening assad still has done it again. We’re talking three twelve on disability stoners to say, hey, i’ll be a million dollars, but only if all of your social media messages on your email blast how everybody to vote for candidate act dahna and that’s the only way you’ll get my money now that was about charity almost nothing, right? Just put that in their email blasts and all the social media messages, but they would be beholden to donors in some cases, or just demanding that they become very part of that. You know, that was problematic. Yeah. There was great potential for that. All right? Well, so thankfully not included, but i don’t think that johnson amendment’s of steel is a dead issue, is it? No, it’s not so it got thrown out of this tax still because they needed to pass something by the end of the year that was that was there their goal, so they knew that that was going to be a battle that was hard going to be hard to resolve right away, but i’m sure we’ll see it hopping up in other bills, including quickly to make sure that we don’t have a shutdown on government. So yeah, we’ve got another bill, right? Our next eleven, and i was gonna call you the next spending bill. We’re only funded through january, is that right? You think that i think they have to do it by january to fix it on extension by january so that maybe their own back instant into play and and again, you keep saying that with the affordable care act provisions as well, they getting thrown back into other bills on, i guess that’s how politics works it’s not very pretty that way haven’t seen the end. Of the movement obliterated, johnson amended, which is explicit core. Also, thankfully, we didn’t lose the charitable contribution deduction completely, which was which was talked about. Yeah, and not only was it talked about this, i found really surprising, but it’s. Just a few days ago, the wall street journal’s, the ford of editors, spent out an article criticising the charities for complaining about attack still, and that that’s, really what should have happened with the repeal of the charitable contributions. And i thought that was quite shocking. But so that was from the wall street journal just a few days ago. I’m saying that charitable contributions, deduction, repeal of that deductions were completely justified, so they don’t go over there. They don’t see the over there and down the street from where i am, a couple miles, they don’t see the double extorted non-profits now facing. Today that they either don’t see it or they don’t think it’s important. And i think the argument is that, you know, just like we talked about earlier, that people should give from their generosity of heart, um, and not for tax purposes. But it doesn’t started taking to attend well, that tax purposes play a price because people, how much income they’re going have left over, you know, with which to live so that a part of this it is something. Thankfully, the repeal of the terrible contribution deductions, thankfully, was not included in any of the pills or in the final law. And i think some of the big charity advocate in the country moving into sectors that council non-profits pompel foundation association fund-raising professional writer. They were very helpful and ensuring that way didn’t provision. Okay, all right, well, if it wasn’t either bill, then it seems to be a good sign that it’s not it’s, not something that is likely to come up again. I won’t be enough political backlash not to see it come up again, but i think people have to be delicious. Yeah, we thought to be vigilant about it. Yeah. Okay. Anything is under attack now, so potentially because a lot of things being being questioned bonem uh all right, what else? Volunteermatch island breeze? That’s the same thing is still gone low dahna you know, i think that was ridiculous. So it’s been suck it fourteen cents for miles to charity, vilified the most of your listeners. You want teo, take a deduction of the volunteer for driving on behalf of charities. Maximum production, you khun sake is fourteen cents per mile. Of course. Doesn’t miree doesn’t taste in the cost of your gas and the wear and tear on your ears. But that’s what? We’re stuck it. And there was no assessment made even though it was in one of the earlier still that never got finalized. The business raises like fifty six. Fifty seven cents. Yeah, exactly. So it’s kind of ridiculous here if you work for business and you drive in the mid fifties area. Dr charity? Yes, i think about that. Right as, uh, you are driving around doing business, the business of your non-profits, and you can deduct that somewhere around it’s over fifty five cents a mile. But your volunteers, we’re doing the same work you’re doing well, not exactly, but they’re further in your corporate your charitable mission, you’re volunteers were giving their time, unconference stated, and driving around, using their vehicle to further your charitable mission, just like you’re doing, they can only deduct fourteen cents per mile, so that as you’re as you deduct and you calculate your your deductions for for twenty seventeen, think about your volunteers and the low rates you know there will be multiplying by point one four while you’re multiplying by point five, six something, yeah, fifty four point, five cents a mile for a business deduction this morning. All right, so fifty five, fifty five. Yeah, and the fourteen cents has been there for twenty years. So the last time, nineteen, ninety seven, so, yeah. All right, so we couldn’t get that one done. But that would have been that would have cost. Uh, money is what it would have reduced the federal revenue, and they don’t know they had to. Tio had to balance it out, so that was something we lost. What else? What? Anything else on the good side that’s that wasn’t included that it’s good for non-profits that wasn’t included. Buy-in yeah, i think there’s a few things, so well, it started out bad. There was there was initially in one of the bill over appeal of private activity bonds, bonds used by non-profits to build schools or hospitals, affordable a thousand organizations for finance purposes, but they wanted to kill that. But that was fortunately, thrown out of the final law that that was taken out. But there still is a repeal of fancy self-funding bonds, which actually has to do with refinancing outstanding status. Lower interest, though there, there is a a portion of that that has gone away, so you can’t get in the van three funding fonds without having to pay the penalty. But unfortunately, private activity bonds are still okay, so that was that was good, all right and again, that’s worth mentioning because you want to preserve the principle that that have been so long standing in on benefiting charities in our federal tax code. So, uh, of course, it was good that they want repealed, but they could have been. And if it had been you, that was been yet another blow to the charitable communities in the federal tax code. The things they think they’re worth standing for, whether whether it affects your five, one, two, three or not, it’s may trickle down. Wait a minute. Buy-in. Yeah, wei have just a couple minutes before, before another break. Uh, okay, what else? What else is beneficial? That wasn’t that could have been worse. But what another thing that could have been worse? It is a penalty that exists if you pay somebody is a charity case. Somebody excessively and often times that’s fraudulently done take give money away to some individuals who used music to charity. Yeah, we’re talking about the benefit is, you know, the person that benefited from that on excellent benefits transactions penalty, which could be a hired one hundred percent of the excessive amount. But if they got accepted unconference duitz but the charities was never hit with a tax on that. It was the person that benefited from the tax and potentially board members who approved it, knowing gives to be excessive. They could get hit with penalty tax to writhe. Bill one of the bills that came out out of the house and senate can remember which one says, no less hit the charity with attacks as well with charity which is now lost money to somebody who’s unscrupulously taking advantage of them is now with for that loss. Well, fortunately, that didn’t make the law, but that would have been another blow to charity? Yes, and that was in one of the bills. That was in one of the bill. Maybe a smaller, really important ones for us is one of the bills wanted to eliminate something called a rebuttable presumption of reasonable and the rebuttable assumption of reasonable is his guide that way get from the irs on under treasury regulations that say he followed these rules to ensure that people are not going to overcompensate themselves with directors are officers and they’re going to enter into some sort of financial transaction with the organization handup fifty, are looking to do that in a good space on the board approved this by a majority of disinterested directors. They’re independent, they’re not related to the director officers is going to get the condom station. It might be, you know, to be paid as the ceo or might be leased out on office or whatever it is. You follow these rules with independent boardmember moving in and getting comparability data and make sure that it’s not excessive, then there is this rebuttable presumption of reasonableness that that the irs was gonna say, i presume it’s to be reasonable if we’re going to attack it’s going to take you to court, we’re only going to do that really they wanted eliminate that. Procedure. So everything was before we’re not quite sure whether we can justify this salary or not, but they didn’t. So, yes, that’s, a part of that was not in there, that we didn’t lose that safe harbor. Okay, you gotta take a break. In-kind hello, credit card, payment processing. And this, uh, you tax law. Well, it’s definitely knew, but, uh, no, no it’s. Not that great. I don’t think, um, anything else? I mean that that that wasn’t included. And then i want to i want to get to your predictions for twenty. Anything else you want, share that baby? Isn’t news that it wasn’t included? Well, i just say one thing, which, which isn’t perhaps, um, good news. Is that the individual tax benefit that we talked about a little a little bit earlier, i said they were temporary, just to know that those just here after two thousand twenty five. So, yeah, doubling the standard deductions and some of these other favorable provision for individuals will disappear and that’s, because they couldn’t reduce the deficit created by the tax laws. Again, bonem benefits going to the wealthy and stick businesses with folks that we see, statements. Five republican congress with the hope of this whole trickle down and eventually benefit employees and everybody else. So individuals have the corporate like carrots. Yeah, the individual benefits sunset in twenty twenty five, right? Yeah, we don’t even get them. Get them for ten years. And this will be done officially that corporate they have no sunset. Whatever longer. I don’t think they have the sunset of their government. Okay, well, that’s. Good for them. Okay, i’m glad. Yeah. Okay. See the reflection from thirty five percent. Twenty one percent tax write corporations almost reduce the tax burden. Yeah, well, those Numbers again to say that 1 more time. From what? The what from thirty five percent. Twenty one? Yeah. Good. I’m happy for them. Okay, now you have the love some predictions about what’s gonna be happening and you wave these from allowed its non-profit law blog’s dot com the first twenty. Eighteen year ahead. Addiction for non-profits twenty eighteen. But you don’t have to go there if you don’t want to get too cocky right here. I want you to know i want him to get traffic on by-laws. What? You don’t have to got it right here. What’s gonna happen to you, what’s that gonna look overall really do well with just one prediction on and that’s going to be the rise of five o went for social welfare. Or is that what that is? About five months support? Social welfare organizations are pretty well known. May not know the code as well as five. One, two three. They include piela used they lose air sierra club and are a onda was w now the’s are advocacy organization and they’re kind of flight five. Twenty three organizations that they are tax exempt and exists for the social welfare of the community. But what’s different inside his stem contributions, not respectable. And the reason for that is taken lobby their hearts, success without limitations. They spend all their money on lobbying to change laws. And they also spend uh along with this has their primary activity. They could devote their activities to endorsing an opposing political candidates so you could see very aggressive positions. That’s not what i would recommend, but it’s very aggressive positions. We could see these five one for organizations. Spend forty nine percent of their income distort things. Can and individuals don’t get a charitable deductions for giving to them. We just spend a long time talking about how the incentives charitable giving has been reduced anyway, right? And that’s. Why? I think we’re going to start to give five, one four organizations because they are unhappy on either side. They’re unhappy with certain latto on e-giving five, one four organizations. Those organizations have a lot of power, and they have a lot of cardio intervene in election. Well, and we’re talking now about twenty five or six percent of taxpayers getting the benefit of any charitable contributions. So for ninety four, ninety five percent of taxpayers, it doesn’t make a difference from attacks positions, whether you give to a five, one, two, three, four, five, one, two, three, four for that matter, if you just give it to a for-profit business, if you want bonem so where i think we’re going to see people who are unhappy with long on both leinheiser buy-in, say, working at a fund social welfare organization, really, dramatically change elections changed. By-laws and don’t ask the limitations. Work-life and we are going to be seeing a lot of importance battles in congress you mentioned earlier around the social safety net, so security, medicare, medicaid, you mentioned the affordable care act, i think they’re all going to be coming up again and again in either in their own bills or as part of seemingly unrelated koegler they are really good deals that get stuck in so there’s going to be a lot of political battles team thought on dh saying five o once before can can engage people buy-in yeah, possibly be more powerful that way, which is why i think more money will flow into them. This is a highly onesie course are also where guards money goes money where the public doesn’t know self-funding political candidates because they’re shuttling their money through five o one for organization, again from an aggressive that i spent forty nine percent of its income endorsing for opposing a particular political candidate. Five twenty three could be none of that a cz longer johnson and then it’s not repealed, they still do five months before it can so scary thing and along the other issues that are really hot and up for advocacy. Immigration dreamers, for-profit inequality gap, a gender discrimination, disability, dahna there’s, just so many hot buy-in issues right now and again, i understand there’s arguments on both sides, and so we’re going to keep money flowing into these organizations to affect election because they are elected. Officials have the power to change law, so you’re predicting more flowing into existing before and more tea for inc. Yeah, more. C four’s incorporated dark money going into the fund elections than influence elections and change elections. Absolutely. All right, we got another prediction. Check it out. Dot com bob, welcome back to the show. Thank you for having me. It’s a pleasure. Pleasure. Thank you for hustle on your way to the studio today. The train was late. I understand, but you’re you’re not you’re not. You saved it non-profit outcomes. Toolbox. Last time you were here was five. Years ago, how’s the, uh, how’s the book doing it. Just come out when it’s been phenomenal. Yeah, it was that just released two thousand eleven. It was released in two thousand. Okay? Yes, it was sixty days before i was here. It’s it’s got me all over the world. The response has been incredible. Not antarctica, but not an article. I think the the penguins and the puffins and particular interest serious in the performance. But the good news is that word has been spreading that there’s nothing else like it out there for non-profits they want to learn howto tio be performance based on dh really start working on outcomes. And it’s got me all around the world. Places i never, ever thought i’d get to see. Saudi arabia and nairobi australia’s been phenomenal. Outstanding. So international organizations are interested in outcomes measurement as well out the united states actually is the leading non-profit sector in the world. Everybody hopes to see what we’re doing. Eso when non-profits started looking outcomes here non-profits in other parts of the world started looking as well. And so i got invitations and there i was. Excellent. Love it. Okay, i’m glad. He’s doing well, i’m i’m i’m even happier than you are. Not literally. The checks are pouring in. Finally, the first one. All right, the first one takes five years. Depends on how big your euro your advances. Jeff, work off the eye. I see. All right, but i finally did. Okay, i don’t want to get details about your personal finance is all right. Just get a a short subject. You know, we have to film. Remember, you have to be together twenty five minutes to fill twenty. We’re going to because we’re going to talk about the history of the charitable sector, which is a part of a new book, part of a new book that you’re working so and so exposes to what the new book is not out yet. Yeah, what’s that going to be about the new book is basically a donor’s guide. It really is basically what you should know about the sector every year we individual americans give billions of dollars. Last year was two hundred seventy eight billion dollars from us, and most of us know nothing about the sector. And so i am, depending upon the metaphor you choose, i’m either. Lifting the curtain or lifting the fig leaf and we all know what usually has been so all right. Ah, fig leaf, i, for that matter for all right. Okay, so when is that? You have a big fat advance that you’re working on now? Yeah, yeah, i’m working on a big fed events. I really can’t tell you because the book is i’m trying to do very, very thorough job. There’s an awful lot that we’re going to talk about today is just some of it today, when we talk about the history part, right, this is not it’s, not a history. Mode is not understanding. This is one chapter isn’t right, you know, one piece. Okay, so all right. So let’s, uh, still into it. Okay, let’s, go back, tio, old england. Oh thing. Which is where our charitable sector started with with queen elizabeth the first what was going on under her fig leaf? Oh, don’t do that to me! Latto charity, as we think of it, was, was vastly different back then. It was it was virtually all individual. But it was not really designed to help the poor. The old christian idea was that by the act of being charitable, the person who was being charitable got some sort of divine grace e-giving charity had nothing to do with ameliorating poverty or helping the poor. It was i’m doing this so i will get good graces. Most of the poor laws had to do with trying to corral and chase the poor from place to place to place. But they were also the divergence of opinion as to really what was charity. And so what elizabeth did was she did a there was an actor. Royal acted in sixty no one. The the charitable uses act and what she did in one fell swoop was she secularized charity. Because in addition to the usual type things poor, the needy, the infirm, the agent she now included as perfectly valid charitable uses things like building roads, building bridges, building causeways, supporting the troops. If you donated money to to to raising an army that was considered charity, the things that you might consider to be almost social engineering a fund for the marriage of poor maiden’s. Because in those days you needed a dowry. If you had no dari your chance of being married, we’re even lower. So this was a fund for the dowry of a poor maiden so they could get married. There was ah, charity was seen to be also thie encouragement and support of young learning artisans and artists and things of this nature. So what she did at that point was expand the concept of charity beyond the usual idea of helping an individual or helping individuals, and more towards what you and i would consider efforts of public benefit public good. And that strain has never left us. Okay. And also similar mints of social engineering. Yes. Helping see the women get married? Yes. You said you said moving the poor around moving the paralysis is moving the poor round. That is the poor laws we don’t talk about. That was that was not very nice. That was not there was rather know thiss was. This was in terms of helping young artisans helping argast supporting them, supporting young young academics. All of these. Were included in the list had never been thought of his charity before they’re they’re after yes, okay, as part of explains, it can just finish white today you can have the opera, you can have a bird sanctuary and you could have a battered women’s shelter all considered charities because going back to elizabeth, all of these sexual things became part of chuck, and now we have just a minute before break, we brought this concept over with us. Well, the puritans i shared i’m in italian, so i didn’t bring it over. We brought something else over, but, um, puritans brought these concepts with them. Yes, it is, yes, but they also brought some. They also had some very, very important individual ideas of their own. I’m not quite sure if you’re trying to go into it right now, but i could go over just over the top number one. It was every person’s responsibility to take care of his neighbor. That was your duty to god, and that was your duty to the king arika secondly, very, very important thing, the puritans, unlike anyone else who came to north america, had the sense that they could use the law to enforce changes in attitude and behavior so if we’re talking about moral standards and we’re not talking about that shot, not till we’re talking about ideas towards social behavior, their idea of a city on the hill, their idea of the new jerusalem, they were going to create a better society, and if you wanted to live there, you had a full flowing line one hundred percent we always see these pictures of them wearing dark clothes that said, all of this was enforced by law, we can get back to it after the broker. All right, well, we’re going to move on from the puritans, actually, because i want to start talking about some of our features of charity today we only have twenty five minutes and, uh, okay, so we’re going to look a tw. What? What characterizes charity today and how that how we got here? That’s what it’s all about let’s, stay with us. Very special show for you with us. Okay, bob. So the so i want to look at some features of charity’s today. Like on this has relationship to the puritans the northeast. So is sort of the first explain. How is it that way characterized the northeast as being dominant in charity philanthropy? It’s, not the northeast is nominated ways going culture is what you have to go again. I hate to do this. You have to go back to pilgrim’s idea of creating a better society. The pilgrim’s. This was their fat. One of the founding ideas you and i chatted briefly before about the split between charity and philanthropy. Weight of these two split well, one of the things that happen is that when philanthropy started developing that that protestant strain of creating a better society informed what they were doing and that has never changed. Most people would think would agree today that in terms of its humanistic goals in terms of the kinds of things that embraces that, more or less, the non-profit sector truly has sort of a liberal caste or a liberal bent by no means to be political. But in terms of things that it embraces. Those all go back to creating that better society that started with the pilgrims and through the eighteen hundreds through the organized benevolence that they spread, this stuff was not down south dahna south at a totally different kind of culture. This all came from the north east. When you look at the non profit sector today you’re looking at the direct descendants of the of the organized beneficence off the northeast going back to the eighteen hundreds. Okay, and today we see that way see just concentrations of charities in the northeast. But you but you always did a cz early as eighteen. Twenty. There were over two thousand of these voluntary associations in doing a little, vastly outstripping the numbers. Any places? Yeah, americans have a have a penchant for tokyo breeding association doesn’t talk to us. You have a quote in the chapter from the total talks about that and he says anyplace. In in europe, will you see a great man at the head of some endeavor, or in france, the government in the united states? You will find an association and that the world that in eighteen thirty? Yeah, and the association’s became associations are non-profit non-profit we’ll talk about how we got there, through laws and recognition and etcetera. Okay, all right, what about women will be very interesting sixty percent of the employees in non-profits air women do i have that rough? If you pray it’s probably more than that, and several women, when they’re friends of mine, would point out that ah, shameful number of directors are actually women, particularly with not latto yeah, with larger number i mean that’s. The staffs are overwhelming when i when i speak in front of groups of very often, there’ll be a hundred people in the room and they’ll be like four males. Honestly, that’s normal where this start this actually was in the early decades of the eighteen, eighteen, twenty just again thinking about this society due to the social mores of the day, women were not allowed to do it in twenty there weren’t even voting well, they weren’t voting they weren’t working. Certainly the middle class and upper class when we’re not working, however, this was a victorian era that had this notion that women were more sensitive, that women had a more perceiving i was also something very, very important going on male world. And that was the beginning of what we call today. Contract theory. It changed. Changed working relationships. I created the world we think of in terms of dickens. What means? Contract theory. Contract theory was its. We write it down. I owe you nothing past what’s in the contract. And if i fire you, i don’t owe you anything. It changed working relationships throughout europe and it hit the united states, the northeast, particularly the east coast. Particularly in the very late seventeen hundreds. Early eighteen hundreds it began to change the relationships amongst people amongst neighbors amongst the merchants and the people with whom we do business. Life got very, very sharp, hard angled and different. Almost a cruel is supposed to have had been women. Women started to see in ways that men refused to recognise the downside off of this, you know, hyper capitalism on the crass commercial world every other evan who was close to them. But this was not. They started pushing for a cz earliest seventeen. Ninety five women were behind the idea of pushing for penal reform. I had a list here i think i could have looked at but every they were against war, they were getting against press gangs. They were against dueling there against inebriation. They were against the abandonment of children. One thing that was a big issue throughout the eighteen hundreds was women being, shall we say, would seduced and abandoned. There were numerous groups, but if you look back as early seventeen, ninety five was the first formal women’s association for social betterment. Again, i have the name somewhere. My notes here. Wait, we don’t even know so we don’t need the name. But the point is it goes back to seventeen, ninety five. Yeah. And by the early decades of the eighteen hundred eighteen ten, eighteen twenties, this movement was almost entirely driven by women of the association’s thes associate these associations that were geared toward social betterment. Now yes, there were associations. There were associations of fishermen there with grange, as they were. Those were not female dominated. But those warm or those worm or industry related those one male dominated because they had to do with the trades. Okay, trades right? Because the men were but doing use the work this think about abila first of abolition. Where was the capital of abila? Abolition? It was boston. It certainly wasn’t down south. And yes, there was a gentleman whose name escapes me. Who ran the paper. But most of his field troops. The shock troops were women. Abolition, suffrage, suffrage, temperature tendered. Yes. Take carrie nation. Yeah. Thes wall women driven and there’s. Many, many, many more. Particularly when it gets around the, uh, child welfare and abandoned women. Orphans, widows. Ah, help the prisoners. All right. Reform price. You mentioned a prostitute. Refund forms pressure not only help for prisoners, but penal reform, penal reform. They recognized the cruelty of the institution. Well, actually, you know, they thought the institutions are better than what preceded it, which included the pillory that stock in public whipping and branding. And so they thought the penitentiary is we’re better than that. And so they were pushing initially for jails rather than bilich stop whipping and brand. Okay, that should have his peanut that’s that is penal reform is compared to what had been okay. Yes, all right, i thought so. They didn’t. They didn’t move out of the prison system or no, they were trying to prove that they were trying to get to a person to person comes whipping, etcetera, whipping, branding, and all right, so it’s ours and feathers. So there was so it really emanated from the with women recognizing the softer side of of life actually know. And there were a diversion and performing over contract the capital prize, the emergent males perception that they had a softer side. They were very shrewd. They knew what they were doing. It was this was not they were soft, and they had these these flowery ideas that just happened to work. They knew exactly what they were doing. But the thing was that the male population stepped aside because it deferred to what it saw. Women’s keener insights in other words, they weren’t playing, that they might have been playing the gender card. But they did very, very, very intelligently. They got what they want. They had their male allies when it came to having people write checks deeply. Clinton for mayor of new york. He was the mayor of new york and the head of one of the biggest societies of social improvement societies in the city at the same time. But it was all being run by these with women, sisters and daughters of the ruling male elite and let’s. See, what they did was they used the ruling male lead to get money for the rest of the men had it? Yeah. Okay. See, i think that’s cool. I get hysterical. All right. Anything you want to say about women, how they emerged as dominant. Well as as the century jin is very, very interesting. Because dominant in numbers, i should say, i mean, there are yes. There are a good number of women, ceos, executive actors, but a very small proportion of of the one, point, one million charities. So what are led by women? What is very, very interesting is the way they kept running and having the kipping resurgent. There was a move towards the early twentieth century which would have replaced a lot of them with male managers who was thought to be much more scientific. But when the sector got basically got into trouble and ones saying that trump latto did anything wrong. But it suddenly found it’s ah it’s, ah, its raison de tre questioned not to mention its sources of funding. It was the women who came back and were able to answer the need when the sector moved to the middle class as its salvation. And this was after the war. This was an era when the non-profits hadn’t what we call non-profits today they were called that, then they really know had no idea what they were going to do it, a lot of them there weren’t that many of them, but they were starving. They were drawing upon the vine, and they didn’t know really what to do with themselves. And it was literally women who saved them by virtue of thinking in terms of things like family counseling and marriage campuses around. This is nineteen forty, nineteen late nineteen forties nineteen fifties. Okay? And we’re seeing so so i guess another another area that i want to cover is services to the middle class. Yes, and it it emerged around the new deal when new deal legislation sort of the new deal captured the poor away from the association, the new deal people think in terms of the new deal is a couple of things i think of the w p a they think of the ccc they think of high was being built in things like this, but they they didn’t offer a lot more because they weren’t not just laborers and construction people that were out of work. They were thinkers, they were, they were artists, there were musicians, and so under some of the new deal programs, an awful lot of these people were hired and they provided services they provided thing, for example, there was one course really interested me how to how to teach people to think critically, and so they were offering this ah, for free public expense. But what was very interesting is that when after the war, the the public, particularly the middle class, liked a lot of these services also think about it in the earlier days, you really couldn’t talk about marital problems that was very probably right, but you sure as heck couldn’t talk about sexual problems. You really couldn’t talk about having problems rear your young because in the earlier days it was but it’s supposed to be the male had a strong hand. Spare the rod, not the child, you know. Spare the rod, spoil the child, etcetera. It was only after the war that these things became started become things people could talk about. It was the salvation in many cases of a lot of these these non-profit agencies, because what they started doing was providing specifically these kinds of surfaces to the middle class. Interesting enough. One of the rationales was the middle class could pay for it, at least in part it didn’t have to all be free. You have to understand that a lot of the agencies that you think of now things like community chest, they really and truly number one wanted to get get away from relief. The experience of of the depression and the new deal when they’ve been pushed out of relief and forced to find other ways to survive. You had really gotten them to the point where they did not want to be back in the release in really space, which was really seen as a descendant of charity. They were much more comfortable in the benevolence, the philanthropy, the betterment of society kinds of kinds of efforts. And they said that on the brothers, all right, rather than charity. So we talked about that before the division between charity. We didn’t get into detail we’re going through, but this is where they were much more comfortable, and that led them directly in the path to be ready for when eventually came along. Great society. It’s such like that. Okay, now, is this the beginning of the divergence between charity and philanthropy? Now, at the beginning of the divergence is actually in the eighteen hundreds. Okay, what was the history of that? The history of that was life was we’re looking back, we think we have this picture of this very bucolic america, if you know, from the colonial era, most people don’t even realize all the things that happens. Say, from eighteen hundred eighteen forty we sort of jumped from george washington to the civil war, but an awful lot happening, like you’d be in the wilderness if you went to fill it beyond philadelphia. That was true, but it off. A lot of things was happening, and one of the things that was happening was that cities were growing new york city was growing exponentially. You had a lot of immigrant groups coming in you had but also think about the older areas of new england, massachusetts, et cetera. These have been farmed out that was there have a great soil to begin with. The ohio valley was opening. People were moving the tightness of the you know, we all have this kind of notion of ah, sturbridge village and the cute little yeah that existed at one point. But by the time eighteen hundred rolled around, ah, lot of that was changing. So that whole idea of direct community responsibility for charity was breaking down. Secondly, when you got to the cities, the city’s had anonymity and that alone attracted a lot of people. There was the structures that had created charity before, on allowed upon which charity had been based before. We’re breaking down tremendously. Number one, number two. The numbers were increasing. And the idea was that charity was a waste. It was a waste of time. Charity comes from the latin word careerist, which means tenderness, mercy and love. Philantech becomes from the greek, which means love of mankind as early as seventeen o four. It was recognized as a term meaning somebody who was interested in the public good in public works in public benefit. All right, they started looking not to help tony or bob because we had problems, but rather while the but problems that tony and bob facing exist nowhere when did this thinking this thinking started by eight by eighteen ten by eighteen. Twenty early very, very early. It was also seen as much more organized and much more scientific. All right, where is that? We can help? We can help the masses rather than one person at a time. They were we could get to the cause is exactly what they were looking to do. Was copy that. Go back to securing that center. I want to go back to the puritans, create a better society. Why do we have poverty? All right now their answer in many cases was very still to their answers. Was if only the pool without more like us. All right, that is. But that is true. Very helpful. No, it isn’t very helpful. But it was awful long for roughing long time. That was the answer they had was the whole period. Called the friendly visitors who went into places don’t like fight like five points, and basically the message is, if only you would be more like us. However, even though they were misfiring because they didn’t have the knowledge we have today, they didn’t have the theory today certainly didn’t have computers where they could crunch numbers. Their idea was this benevolence. The idea was they were trying to change society, not necessarily help people. So that was the division between charity, which has always been direct and specifically focused on individual family and philanthropy, which is always had much broader goals and has always been much more abstract. But that that split literally tony goes back to the early decades of the eighteen hundreds. Well, okay, cool. Um, let’s move forward a little bit, tio. Some of the recognition in the in the tax laws. That’s, that’s. Really? Not really about really, like two minutes left. So you’ll have to go through this little quickly charity’s. Well, first. Well, there was first non-profit status was like nineteen. Nineteen o nine. Okay, let’s, let’s, go back. We only have about a minute and a half. Now then let me do. The talking like men and they haven’t finished. Ah, before the before the turn of the last century, almost all taxes were levied by states churches had never been. Churches have never been taxed. It started with churches, property belonging, the church’s libraries. But all of this state law it was not until eighteen, ninety five something in that area when the federal government first mentioned not the charitable organizations that in caldnear non-profits charitable organizations, they were exempted. Then later it was codified that they had to be non-profit it was charitable organization first then non-profit what we think of today with the whole tax loss set up with the five o one sees that did not happen until nineteen. Fifty four and they were not in those days twenty nine categories of five a onesie. But just let again your listeners understand what we have today in terms of the tax exemptions. Number one this goes back centuries number two it’s started with the state’s number three. It became the law of the land when the feds put it in around red, around world war on dh that actually the exemption, the personal exemption for giving it inevitably goes back to the world will want here. Okay, so again, everything we see today, tony has roots a long time ago and that’s the overall theme of this particular part of the book. They’re working outstanding. You do? It’s a sweltering one here in in here, in washington. I almost said new york city’s the mid eighties what’s it like in san francisco. It’s actually a pretty comfortable, like, seventy two out here. No big deal. All right, san francisco’s. Always bragging about their weather. You always boasting about that? Not in juno. You have june gloom you had. Did you have fog earlier today, june gloom we’ve had some june gloom way we’re headed towards july and the sweet whether or not yeah, well, we’ll worry about that. All right? Another time, all right, overtime rules, overtime rules have changed, gene, and it take a takes effect december first, so there’s still time to plan, but this has some serious implications for non-profits it does, and i think most of us are sort of generally aware of overtime rule that enough if you’ve had hourly jobs before, like i have tony, but, you know, we sort of get used to that idea of if we work more than forty hours per week is a narrowly employees were entitled to overtime time and a half, so i remember being an hourly workers that was actually sometimes a great thing to have to have that extra income, no, but i think what’s less known is that even if you’re paid a salary and so let’s say you’re paid, you know, thirty thousand dollars per year or something and not on an hourly basis, you might still have the time. The right tio overtime if you work more than forty hours per week that sometimes little known and little understood both. By employees and employers and generally the way people think is that salaried employees if you get a salary and not an hourly wage, you’re kind of in that category of exempt employees, which are those who are exempt from the overtime pay right, but not all right. And so that the most common forms of exemption are referred to as the white-collar exemptions. I mean, those are the executives who are, you know, usually managers managing two or more employees. Um, the professionals who are like, you know, teachers, lawyers and doctors. And usually it requires a degree and some sort of certificate, our license and the administrative imp ploys that are performing office and non manual work that’s directly related to management or business operations. So those are the typical salaried exceptions, the white-collar exemptions from from overtime. Okay, let’s, let’s acquaint listeners were, uh, and me with what what’s what’s changed. What’s the that’s not bury the headline what is new about overtime? So what is new is those white-collar exemptions were subject to a minimum amount. So even if he falls under the definitions of executive, professional or administrative straight of professional if you were making less than twenty three thousand six hundred sixty dollars, which is currently the threshold. You were entitled to get overtime if you work more than forty hours. So that’s what little known if you made less than twenty three thousand six hundred sixty dollars, you were entitled to overtime even if you were a salary. Now the law that’s changing says that minimum threshold is going up by more than double, so the new threshold is going to be forty seven thousand four hundred seventy six. So more than forty seven thousand where the old threshold, which will apply until december first, is only twenty, twenty three, twenty three so many more people now eligible for overtime pay, right? So basically, everybody who was salary between twenty three thousand six, sixty and forty seven thousand four hundred seventy six are entitled. Teo will be entitled to overtime pay time and a half based on their salary starting december first. And how do you calculate? What is the hourly rate? You just you just divide the weekly salary by forty? Yeah, i think you’re just going to do on on a pro rata basis. You, khun divided by the number of hours that you work in a year for for for a worker and then that’s the hourly rate your time and times it by time and a half. Okay, now this applies to all employers, right? This is not just non-profits that are being hit, it applies not all employers, but non-profits don’t have a special knows i’m from there. Okay, no special exclusion for non-profits and it comes from the us department of labor, right, not california law. Now this is not right for once it’s, not california, but people should know that they need to look at the state laws because the state laws sometimes might be even more strict than the federal laws. In some ways, that could be more difficult for employers, and in some ways, this increase will be much, much less for for state law. Under under state law in california, for example, are current minimum for exempt employees is forty one thousand, so that jumped to forty seven thousand isn’t so big. The federal level is jumping from twenty three thousand forty seven thousand much much hyre increase affecting many, many more employers and employees. Are there any states going above the forty? Seven, four. Seventy six and none that i know of. Okay? No. None being more generous. All right. Right. But i understand important. You do need to check your own state law. Yeah, and california will will probably be over that that amount in a few years as they’re targeting a fifteen dollars, minimum salary, hourly rate and the example categories will go up with that over a number of years. All right. You said no special exemption for non-profits, but some non-profits are accepted. No, no, no umbrella exemption for non-profits. But there are some excepted non-profit categories. Yeah, so not non-profits so generally you khun get you can fall under the coverage in three ways, and one way is just by operation of state law. So i’m going to leave that out for now, because the states will all differ on that. But the two other main ways to get covered is one if the non-profit is considered a covered, enter surprise. So a little bit of jargon there, but generally that means one of two things. One is that they’re one of these named enterprises. So if it’s a hospital or an organization that takes care of older adults or people with disabilities who reside on on the organisation’s premises or schools for children who are mentally or physically disabled or gifted preschools, elementary school secondary schools and in colleges and universities all covered so all their employees air covered as well the other type of non-profit but that would be great, but i need to understand something covered means they’re they’re subject to this rule, or they are not right. They’re subject to the new to the new law, right? So, employees, uh, all of those named enterprises are going to be subject to those those new rules in the new threshold for overtime. Okay, so those are categories named enterprises. All right, so you still might be outside the named enterprises? Absolutely. Okay, most non-profit they’re probably not just in the strict categories hospitals and schools. So the other way you get covered is if you have ordinary commercial activities that result in sales or business done of at least five hundred thousand dollars. Bonem so that the church here is its commercial activity, so they’re not talking about donations, and they’re not talking about income that’s directly related to furthering your charitable purpose, they’re talking about commercial activities that they’re more like unrelated business activities. So if you’ve got that type of commercial activity and i should say that commercial activity and unrelated business activity under the tax code with unrelated business income tax, they’re defined slightly differently. So i’ll just say this is more broader. So if it’s a commercial type activity that’s being done for-profit and you’re you’re intending, tio, i run a business to generate income for the non-profit no matter where the profits go, you’re just running a real business, and if it’s you’re making at least five hundred thousand dollars on it, then you may be a covered enterprise, and then all of these the new thresholds for for the overtime are going apply to your organization socially. So still a lot of charitable organizations that are not covered yet, but well, based on what we’re going through because you’re right, you have the named enterprise. Is the covered enterprises the named ones? Yeah, half a million dollars threshold in commercial activity. If you’re over that in commercial activity, then this these new rules apply to you, but okay, we’re still talking about a lot of charities that are not going to be impacted? Not yet. Okay, what’s your other category. All right, so any non-profit who has employees who are engaged in interstate commerce so that business transactions basically between or amongst different states and including whether you’re on on the phone or whether you’re doing business not on a very, very rare basis, but somewhat regularly interacting with folks or businesses or other organizations across state lines that does that include fund-raising activity? Yeah, that could that could. Well, this is a close one having this’s not not not going to just be donations there so it’s beyond just simple fund-raising it’s beyond okay, now i’m gonna i’m sort of putting you on the spot, so if you can’t say definitively, you know, of course, you know, use your usual loyally skills toe qualify, but this is going to be the biggest one that would potentially potentially that’s why i’m asking the question sweet lots of non-profits in if you’re if i’m a california charity and i’m making calls to nevada for fund-raising or sending e mails or any of these other things that our solicitations that you and i have talked about when you get into that whole charity solicitation registration realm, if you’re doing these things across state lines, is that the kind of activity that you’re talking about? Yeah, if you do it on a fairly regular basis, that could be activity that that we’re talking about. That’s, a book category, if you’re looking for donated items that are going to cross state state state lines, that maybe what we’re talking about, a swell. So any movement of persons or things including donated goods across state lines, that’s going to trigger and just the employees who are engaged in that activity that doesn’t cover all of the non-profits employees it’s just the employees that are engaged in that particular activity. Okay, so most likely this is going to be your fund-raising team, if you’re going across state lines and, you know, depending how big you are, you might have ah, corporate sponsorship team that just just does that sabat crowd funding is going to be implicated, right? Yeah could be we’re not really sure crowdfunding is so so new and not really caught into how the rest of the laws are our thinking about interstate commerce, and i don’t exactly know how that will. Work, especially with different intermediaries that that help out in the crowd funding. Provoc okay, yes, the intern, yes, those platforms as well. All right, gene let’s. Thank you for being on the phone with me while i, uh well, i think all our listeners it’s important, important it’s. So impressive in an international scope of your listeners. It is it’s cool. Did you know? I don’t know if you were listening earlier today. Did you catch our listener of the week at the top of the show? The executive director of california symphony. I did not. I’m sorry i missed that’s. Okay, aubrey burghdoff hour. Do you don’t know? Do you patronize california symphony? I patronize symphonies in california. Ok, well, hopefully audrey’s. Not listening any longer. Okay, um, let’s. See? So we have ah, you know, we have our standard, like five minutes or so left. What? What are some things that non-profits should be looking at doing to make sure that they are in compliance come december first? Sure. So, first of all, make sure you check to see whether you’re covered or not. And the one broad categories i just refer to very offhandedly was coverage through state law. And note that there’s the national council of nonprofit says that in at least eleven states, including new york and new jersey, the federal rules will apply to virtually all employees and employers, including of non-profits. So watch your state law coverage as well. In addition to the different coverages we talked about, can you a gene? Can you name any of the other states in that eleven has, according to them, it was alaska, dc, illinois, maine, maryland, massachusetts, missouri, new jersey. In new york, they said north carolina and ohio ok, and, uh, the national association non-profits believes most of the non-profits most or all non-profits in those states will be covered by this subject to this bye operation of state law regulation or administrative ruling will automatically apply to virtually all employees and employers. Okay, thank you very much for that in nouma rations. All right, so you got to know if you’re if you’re subject to it, then what if you are? Well, then you’ve got to do a lot of planning, right? So if you’re going to be subject to it, then you gotta start managing and figuring out your budget and what’s so difficult about this is it starts in december, so not too many people are going to have a chance to react to this with their next year’s budget. They’re gonna have to figure out how this is going to impact. They’re this year’s budget um and so so then they’ll have to figure out what do we do? Are we going to do we regularly use over? Time first of all, on our employees covered on are we going tohave teo find different alternatives? Do we need to maybe hyre part time employees or spread out the work in a different manner? So we discourage? Oh, our lesson are need teo give overtime pay? Or do we provide pay raises that increased the worker’s salaries to the new threshold? So so we are sort of been sink overall on we don’t have to pay overtime if we can get them up to that new threshold, and if they’re very close to it, that might be a cost. So one of those is heartless and the other is altruistic, but if we start cutting workers, reducing them to part time that’s ah that’s bad for them. Oh, actually, what i was suggesting and, you know, there’s there’s good and bad to all of this, but when i was first, suggesting is hyre part time employees, new employees so your current employees don’t have toe work the overtime. Oh, hyre new employee. Okay, i was thinking, reducing current employees to part time and bringing on more. Yes, so what? What the critics they’re going to say, though, is that that may not happen, but what may happen is that with the increase costs that are going to result because of the additional overtime taste, some non-profits they’re goingto have to pay starting in december, they may just lay off workers or cut programs instead. That’s a scary thought has that i’m sure somebody has raised that. That doomsday scenario yeah, i mean, it’s interesting. I’m not sure how you feel about it, i’m you know, without having a chance to sort of really study it, but there were over two hundred thousand comments that were sent when the first proposed these regulations to the department of labor. Most of them were pretty negative, and a lot of those negative comments came from non-profits that we’re saying, you know, first of all, we had no chance to really react because the rules come in place so quickly by december, and we didn’t really account for different geographic, you know, cost of living issues. So, you know, making you know that amount forty seven thousand in new york is probably one thing or san francisco and making it in oklahoma city or somewhere else, maybe very, very different. So there’s some really good criticisms about it and some difficulties, some non-profits especially in those rural areas that are going to have to face, on the other hand, they’re people that say, you know, we shouldn’t be taking advantage of workers just because we’re a non profit organization and paying them at a rate that’s below poverty level for a family of four. And that was the reason why the administration had justified that shift has not been changed since two thousand for so where twenty three thousand is below the poverty level. Yeah, family. In fact, i think the twenty three thousand is well below poverty level for a family of four serving one person making the income from that family okay? And where does the new forty six or forty seven and where’s that in respect to the poverty level, do you know what this is? How they defined it’s? I’m not exactly sure how they compare it exactly to where the poverty level is defined, but they say it represents the fortieth percentile of earnings the forty forty out of one hundred forty percent of that’s not very a fulltime salaried workers in the lowest wage census region, which is the south so forty percent out of full time salaried workers, that’s forty seven thousand in a place where the cost of living is lower, right is the lowest and okay in south. Okay. All right, well, you got to take these things, maybe incrementally, but it definitely, you know, it’s yeah. I mean, it has budget impact. And, you know, i’m not surprised that a lot of the comments from non-profits were negative. This this is gonna cost. Yeah, it’s definitely going to cost and it’s going to hurt some people in services, you know, maybe the counter is sometimes you’re gonna have to take some steps back is on on an organizational level. Welcome to tony martignetti non-profit radio coverage of opportunity collaboration twenty fifteen we’re back on the beach in x top of mexico with me is paul lobe. He’s, the author, most recently of soul of a citizen and the impossible, will take a little while, plus three other books before those those two have sold over a quarter million copies, you’ll find paul lobe the impossible dot org’s polo. Welcome to the show. Glad to be here. Thanks. I’m glad we’re together on the beach. I want to talk about avoiding burnout. A lot of your work for decades. Going back to the seventies is in activism. Citizen activism, right? Taco actually, let’s. Start with a cool story that i heard you tell about rosa parks. So it’s. Interesting. Because rosa parks is the sort of story that everyone thinks they know. You know, i can go. I can be overseas and people know the name. I can talk to eleven year olds and they know the name. Oh, yeah. She’s the lady on the bus. But what’s interesting to me is that most people know in a certain version and they know it as one day she was writing on this bus and sort of just feed retired. She just refused out of nowhere and single handedly launched the civil rights movement. You know, all by yourself is this lone heroic woman. And i get very frustrated when i hear that story because duitz it strips away the context that’s, so important. I understand that actually is much more empowering that that story. And so i look in there several elements. There’s the one he is that’s, their mistake, the element of community. So she at that point is the secretary of the end of the civil rights organization in montgomery, alabama. And she has worked for dozen years. With the co founded by her husband, that particular chapter was a barber in the city and she’s doing these sort of humble towns, like getting people to come to meetings and all the stuff that certainly is not going to make the history books or the network news or even page six of the local paper. And when you take that away and you take out all the other people that she’s working with, it becomes a sort of lone crusade, which is very much a mythology of our culture. I mean, you know, one of things i sometimes bright lad in the language around social on for ownership is lone hero. Super person. Yeah, but she’s part of a community that she’s built and there’s others in it. There’s ah, a union organizer, gotomeeting nixon who’s, the head of the local. At that point, he’s, the person who gets a very young and reluctant martin luther king involved king is all these excuses. He’s young he’s, new in town is king was reluctant to join. He was reluctant to join. Yeah, he’s reluctant step for we think of them as leaping forward, but at that point he has not really fully he’s not embraced that path. He’s still, you know well, i i’ve got divinity school. I’m going to be a minister and it’s not at all clear, that that’s going to be his direction. So he’s looking, i think warily at it and there’s a phrase i used the perfect standard, which is the notion that you need to know everything be the perfect place in your life be the combination of sort of albert einstein, gandhi, king wonder woman, mother grace, you know, add seven other people. You know, none of us is ever going to get there so and it’s also about the perfect time and place. And of course he he’s saying, well, it’s not the perfect time in place. I’m too young. I’m do knew all the excuses, you know, in his case elements of truth, but he’s their excuses. And so it’s nixon, who persists, gets king involved. And montgomery is where the world hears the king as well as in rosa parks. So when you strip that away and you make it the long hero, it ends up, i would say, being very disempowering to people, even though think it’s an inspiring story because they have to be as her work as the perceived the problem with rosa parks pristine rosa parks as opposed to the real heroism which is doing the stuff day after day after day hyre and then the second element is that they think it is a sort of accidental action. One day, her feet hurt buy-in there she wasn’t the first person refused to move to the back of the bus. There was a young woman who was actually unmarried and pregnant, they decided not from the youth section not to build a campaign around because they’re up against enough as it is latto strategic decision and these parks had got the summer before arrests, going to trainings at a place called highlander center labor and civil rights center still going in tennessee despite being burned at once by the group klux klan and so she’s meeting with an earlier generation of civil rights activists smaller moving but still certainly present and when she acts it’s intentional, intentional doesn’t mean she knows the outcome. I always said that, there’s a two, two aspects one is, you’ve gotta have a leap of faith, the minister, jim waller’s from the social justice magazine, sojourner says hope is believing in spite of the evidence and then watching the evidence change. Yeah, so, you know, by your actions, you change and you have believe in faith about the possibility, but right next to that is intentionality, which just means you’ll be strategic. So you’re looking at you’re saying, ok, what you want accomplished? How do we get there? Who are allies are the obstacles? How do we get the resource is how do we carry it out? How do we tell our stories? All the practical stuff? Of course they had to deal with that montgomery and and when parks took that leap, she also knew that it was going to be part of intentional campaign. They would run his best they could, and, you know, they’d see where late and it is, yeah, i love the story because of the intentionality aspect, and that leads us to the social change work the people are doing now, right? And where we get to the potential for burn out in all this day after day after day after work that is so intentional and so time consuming, right? And and so and so emotionally fraught. And the stakes could be, like death and disappointing. Yes. And i just pointing, yeah, yeah, you know, never enough resource is all of those kinds of things. So so i think there’s a third element that’s missing is perseverance, which is okay, you know, twelve years, if she gives up in your tender rate, we’ve never so and so and so that that carries into that question of burnout resisted. You have to keep going. So let’s, spend some time talking about empowering people toe, right? Not burn out in their day to day work as they’re going about their struggles. Where? Wherever in the world yeah, you you believe a lot in support and they do. And the disempowerment of isolation, isolation is the killer. I mean, when you feel like you’re the only one, you’re up against everything, but when you change it to okay, we’re up against a lot. But there is a on the wii doesn’t have to be thousands of people. It can be three or four people that are the ones that you rely on but it’s so easy. I mean, i i find myself i run a project. That i found it that gets students engaged in elections using the resource is of the colleges and universities shut that out, what’s the name, the campus election engagement project, listselect dot or yeah, it’s really demanding on, you know, re sources and on also sometimes, you know, really hard personnel situations and, you know, because this comes up, you hire people and sometimes problems that you and i, rem number one particularly acute situation, which really wass i mean, it was just the kind of thing we are going to details that just wrenches your heart, wrenches yourself on it had the potential to destroy the organization and and just trying to deal with my own and then, you know, call. I talked to a friend who we have really wonderful street newspaper in seattle where i live real change that we’re homeless, people sell it, and it’s, partly professional staff partly almost poses a great model and, you know, i just called my friend who ran it it’s like, ok, tim, why don’t i d’oh it’s like, you know, you really you know, this is something that you can’t you’re not large enough to handle this on your area on you know, you just hear this, you have to be ableto, you know, hard as it is to say, this person can’t be apart the organization because, you know, it’s just this otherwise you’ll be in constant crisis that we need to have support yeah, it could be it could be colleagues similarly situated in the community or across the country, right? Yeah, i could be with funders even made the tech with technologies we have, you know, it doesn’t have to be geographically focused, yeah, but you do have tohave and you have to have a team of folks i mean, on the other side is we’re doing, like, i mean, i’m asking people in my election project to basically take the culture of a college or university, get access to the administration, and we go in through some networks that they tend to work with, but even still, you know, and the student government convinced them to do something that they haven’t done before, or now that some of them now they have done because they worked with us, which is to make a priority of registering their students to vote and getting to reflect on issues and helping them turn out of the poles and all non partisan does this last? Lorts yeah, and i mean, we’re just think, okay, here it is, here’s how we’ve done it before go do it and so it’s hard. So, you know, part of even like, working it’s harder working virtually, but we have our conference calls each, you know, in the heat of it geever and me, we’re gonna do a video and we don’t go hang out or whatever, and we’re supporting each other, we’re appreciating each other’s successes were brain streaming through the do the project, we also have coaching the cohesion in the group is what sort of were being extremely were being extremely intentional cohesion doesn’t happen automatically were laughing and making jokes were talking about did something cool happened in your personal life? Two be able to sort of give people the sense that it’s not just because in our particular case, they really are physically on their own there’s not somebody in an office, but they’re off on a college campus know whether off where if they happen to live, and then they’re either talking by phone or visit making site. This is tow campuses, but they don’t have the calling next to them. So we try and very intentionally create that community because otherwise they will burn you’re tuned to non-profit radio. About in in recruitment, there’s gotta be there’s gotta be things that you look for bringing people to the organization that are going to help create this cohesion, you know, it’s a good question, i’m not, and i wouldn’t say i’ve always been perfect at it. I would have had my share of fallibility, but i do think that, you know, as i learn and we all do, you know, that being able to i mean, have a strong sense of self but also know that you’re not going to do it all on your own know that you’re going to be working with others no, that have a sense of humor. I mean, if you’ve got a sense of humor and helps help cement slim and you see people in just, you know, dealing with the hardest possible, heart wrenching situations and there’s a sort of i mean, somebody called gallows humor, which french trenches humor has in-kind wartime or whatever guys get you through it’s so important in prison culture, they talk about the brotherhood of suffering, yeah, it helps to be that cohesive group, right? And so, you know, one of the stories i tell in the impossible. Take a little while is you know, they’re breaking it. Robben island prison in south africa. You know, they’re telling mandela and all those other folks, you know, you are going to rot here. The world has forgotten about you. You will never leave here alive. They isolate him in every way they can. And so they’re breaking rocks in a prison courtyard and they start whistling a freedom song and just just that, you know, okay, we’re not allowed to have this political conversation, but we all know what this means, and they’re they’re ice. They’re denied newspapers and, you know, further isolate him and they see a guard. Who’s got his tuna fish sandwich wrapped in a newspaper and throws, you know, it’s sam with sores on his paper in the trash, i take it, you know, surreptitiously under their shirt, they see a story that they think might give each other heart. And in a kind of coded script on toilet paper’s only paper. Most of them had access to the right, you know, just something that will tell that story of the outside world so that you are connected to the outside world into each other and then they pass it hand in hand, you know, when they’re waiting, you know, had lunch or whatever, but they have a chance in the yard. Yeah, so it’s just it’s those air extreme situations, but they also suggests to me that and this is the lesson of both soul of a citizen and be impossible to take a little while that in any situation, you know, you don’t have to be faced in prison. But if you’re doing difficult work, you need that camaraderie. You need that community. And you have got to be, you know, recently intentional about trading it about the scope of the work of the organization being judicious about what the organization takes on, right. So it’s not straying from mission and and stressing stressing in killing staff? Well, yeah, i think we are. I mean, i think we all face that challenge because if you’re trying to do something, i mean, i have the needs are so great, the needs are so great. And i always encourage people to think really large and to tackle big systems on a lot of times. There’s a tendency to sort of yeah, which describe it. It’s i think there’s a value in that more delimited personal work, it’s i don’t want to demean it in any way. Hyre but i remember stanford students saying very well meaning lee um, i’ve learned so much volunteering at this homeless shelter, i hope my grandchildren get the opportunity to volunteer at the same homeless shelter that i have and as his friends sort of try to gently remind him that really wasn’t the point. And so if you’re working at the homeless shelter, which is great, you wantto look upstream and you want to be able to say, okay, what am i learning from this one on one encounter? And how do i buy-in with others and joined together others to tackle homelessness on a larger platform? Because if you don’t it’s just going to the endless parade of need, so i think that that’s true and at the same time, well, where do you draw the bounds? And you look around at the issues and there poverty and inequality and climate change and, you know, went on and on, you know, police violence, i’ve got stuff on on on how do you deal with all of it? And so i think part of it is just you do have to think about what your capacity is. You do have to think about the past people. I tend to be somebody who thinks large and tries to get my project and staff to think large and probably, you know, maybe drives them a little too hard. But by my national directories is one of twenty eight year old is pretty good at balancing. All right? You know, this is what we can ask people to do. And if they do it, well, that will matter. But i have this wonderful friend who i nufer years who died at a hundred to is an environmental activist. And of course, you know what time she reaches our, you know, late eighties and nineties, um, you know, you’re asking your weather sees her secret of longevity is certainly but also her secret of being able to keep doing this work. Yeah, on dh. So, you know, one of the phrases she does that you know, you you do what you can, you can’t do everything you have to say no to people, but you could do what you can and then you could do some more, and you could do that your entire life. And then she also another point she was talking about reviving our spirits and she said, you know, you go kayaking, you go hiking, shooting both into her nineties, and she gets the mist of a smile and she says, then you come back ready to take on exxon, you know, so she’s willing to take on exxon, but she also knows that she has to go do those other things to renew her soul, you know? And, you know, and humor and just she on this sort of goes to the recruitment to you, right? You recruiting hole people? Yeah, you have other interests beyond the work that you’re you’re hiring them for your not recruiting robot? Yeah, no, absolutely. And so i think having, you know, having people who really are just i mean, it’s hard because i always when people are passionate about the car, but also but not one dimensional, but no one dimension. Yeah, yeah, and not, you know, we’re not recruiting robots. What about the idea of the bored as potential support you, you know, in times again, times of burnout. We’re not talking about yeah, fiduciary responsibilities, but hyre valuable to have a couple of trusted board members who, you know, i would you can’t trust confide in i mean, i would say the trusted people can be anywhere, so i think, you know, if they’re on the board that’s terrific, you know? And there was also i mean, sometimes you sort of worry, will you exposure in, er, you know, the afraid of the classic phrase about politics and sausage making it’s like you really don’t want to see how the sausage is made? I mean, there was there at least those those sure are mediators and made sausage sometimes i really don’t want to see how it’s made and, you know, do you expose the inner workings that boardmember than thinking, oh, my god, this is like, you know, we’re in crisis, we’re in crisis, you know, you know, and the same things too, with funders, i mean, certainly myself, you know, there’s funders who i have a very serious, trusting relationship you really do want to know and who i trust if they recognise that oh, everything is not going perfectly, but this is true in any organization and is not and is perfectly compatible with doing astounding work. You know, i remember i had a staffer once was running operation brilliant, brilliant guy and you, you know, innovated. A lot of the things that moved us forward is an organization about at one point he liked to plan, which is good because he brought. He brought us to a higher level of planning, and planning is really good, but at one point, he said, it’s supposed to election, he said, you planned all this stuff out and, you know, it’s all going out, it’s all happening, different blade. Yeah, and i’m like and yes, and that’s always going to be the way it isthe it is gonna happen differently and the planning with good and it makes us respond, you know more effectively, but there’s always going to be if you’re doing anything worthwhile, ambitious enough to be worthwhile, there are always gonna be things coming in from left field and purples and what not and it’s just how about sort of going backto what the one hundred two year old activist saying she kayaks, etcetera, right? And he’s mischievous? I mean, she remember us hundred two years, i think, like he was busy in your party little chablis apartment lived on second, section eight subsidence dilgence social security, which, when she was twenty three years old, is a young union activist should help lobbied through one of the first public pension programs in america became a model for social security, so something she didn’t twenty three or four benefits there are ninety eight and nine, one hundred, and i think her i can’t see what she was talking about her landlord and said, well, you know what? If something happens, you know? Yeah, just dig a hole in the backyard didn’t pretty small letter and take up my case, you know? She just was she didn’t know there was one point. Yeah, there was a reason in central america something there was a congressman did she met. It was very active in the audubon society and who very condescendingly in the way that when does towards the old and the young i said to her, oh, so i hear you’re a birdwatcher like isn’t that? And she said, yes, there’s a lot of birds in washington d c but been watching these days, but i was thinking of the kayaking, she she takes care of herself, she takes care of its just got this wonderful sense of humor, right? And she’s a kayaker and yes, you know, so having similar to recruiting people who aren’t one dimensional, not being one dimensional yourself. Yeah, i mean, you do have to take care of yourself. You do? I’m a big proponent of naps. Yeah, i’ve blogged about the the the the love i have for napping. But whatever it is you do, you need to have something outside. Yeah, yeah, i know. And it’s true and, you know, and again, i think we all wrestle with i mean, i certainly rest that it’s like, yeah, you know, my wife’s going out to see a play? I’m she works very. She works very hard, but in a more contained space, probably ad, you know, and i’m like, yeah, i got this deadline i got to do this, you know? But you know, if i over the years, i’m a runner. And run early sixties been running since i’m fifteen and fortunately, my knees haven’t given out and so, you know, if i go run, i also live in seattle, so i get to run by water. But, you know, if i’m traveling, lecturing on the road, it’s, like i take a break, which because i make it sound like my living, you know, i take a break and i run along usually if there’s water around, i’m going to run along the river or the stream of the, you know, whatever the lake and it just, you know, physically, it flushes me, you know, the toxicity out of you, but it also just, you know, it gives you a space and it’s it’s, you feel better afterwards? Endorphins, there’s lot to be said for endorphins, flood flow. All that stuff suppressing the stress hormones. Yeah, yeah, i can think of offhand. Well, dahna general in one of them. Yeah. Suppressing those. Yeah, and building up endorphins. And yet, yeah. And i think also things like diet. Yeah. He’s getting enough sleep? Yeah, yeah. I mean, i called. I mean, i called the holy trinity of, you know, exercise diet, which includes, um, good supplements. So yeah. Okay. Now, now, there’s not a not on the suicide. Very practical. And you know what? Yeah, you are dealing with serious dressed. This will help. Uh, this will lower your cortisone there’s. Another right doesn’t stretch on and, you know, and sleep, were i my sleep tends not to be that great. So i just figure okay, i’m gonna log nine hours to get a where you get seven and a half, okay? You know, and you know, and that helps about switch gears a bit to the two donor-centric dahna burnout, right? You know, i’ve been doing this. I’ve been supporting this cause a long time. I feel like it’s time to move on. I need any advice around that. Well, i think part of what happens is people have this constant pressure to sort of see the quick short term results and a lot of times howard’s in new york by accepting the impossible take a little while, the greatest story. And he talks about the optimism of uncertain you don’t know when the moment will turn you go backto parks of all the wasn’t like she was doing lots of things for twelve years as they all were one of them little spark. But you couldn’t anticipate which and so i think, it’s, very it’s. Very easy to sort of say that success is for human dignity that we’ve had were inevitable civil rights movement. Of course. Eventually they would have revealed gay rights in eventually. Well, our environmental challenges open question whether we will be able to you do what we need. Well, we are able to do what we need climate change. But they have the will is yeah, the will for it. I mean, right now, you know, the technology is there. Renewables have now passed, you know, they are cheaper than coal. There are equal with fossil fuel without any externalities at all. And you know, when next molly’s it’s not even close, so but will we have the political will? I don’t know. Um, it depends on us and you and the stakes are pretty ultimate because, you know, we’re talking about the habitability of the planet. So, you know, when i when i look at it, you know what i what i see is donors being subject to the same schools is the rest of us, but possibly possibly in a more immediate way because they’re not actual sum of money but a lot of making sure they aren’t in the field, they’re they’re dealing with, you know, with them, you know, then the publicans of hands, possibly and it’s so and they’re getting reports, but they may not even have time to read the reports and, you know, depends on how good the people are a storytelling and so i think and, you know, let’s, be honest, at least some issues, they they may be insulated by privilege, they’re not, you know, they’re not seeing in their social circle, and i remember talking with one of our funders, and she said, well, she has a couple different pieces, like one of her groups, they are just not always down in silicon valley, they are just not at all concerned about this stuff at all and, you know, so she’s in an environment that is not reinforcing her concern yeah, yeah, that’s but, you know, that makes it harder to continue as a donor, then everyone’s talking about these urgent issues and oh, yeah and, you know, here you are, so you’re trying to address them, so i think you know, the challenges well for the rest of us, to try and offer that perspective in our work, which is hard because we’re often mean again, the stakes couldn’t be life and death, you know, they’re huge, even if they’re not immediately life and death wait care passionate about our summit is to myself, it’s like this is what we can do, and we want to put these many people on the ground in our states in time to really work with the school’s for this election and the clock is ticking and, you know, so theo, from the donor perspective, if you want to try and really see that long term, you know, i mean, and of course, you want to be rigorous and you want all the rest of this stuff, but not get but see that long term goal is here long term goal recognize the the short term, the short term impacts we can have, right? And but you also see the longer the wait and see how things build on the other thing i think is, you know, there’s a certain, you know, i would argue that our our culture, including certain the non-profit donor intersection, has that has adopted on obsession with certain kinds of measurement to the detriment of other kinds of metro meant measurement. And so it’s, metrix, metrix, metrix, metrix. And i mean, i mean, i’ve been seattle in a city where it’s particularly talks because we’ve got a tech culture. And yeah, some of the numbers could be exceptionally important. Question about that. But here’s, a story that embodies the process of what’s occurring. That can be equally indicative. And so when you’re trying to evaluate impact, which is a reasonable and good things, you want to take that broad, long term picture. And you want to get the understand all the different ripples of a particular organization you’re supporting our considering supporting on. That that’s that can be as warm or important. Then then the numbers, you know, and not to dismiss the numbers, you know, but another way of measuring there’s qualitative his bed storytelling as well. Yeah, but, you know, in which can include numbers which can include numbers the air of i mean, you know, when i talked to donors, they know we have some very good numbers on our project. Yeah. Mark, best calculations. A couple hundred thousand students who voted our last year who wouldn’t have otherwise? This is huge, you know, for a tiny minute budget of labbate. Ah, half less than half a million dollar budget for that level of impact is amazing. Yeah, yeah. You have about a minute left or so you’ve been doing activism. What? Forty some years? Forty something years. It creeps up on you. What do you love about it? Why do you keep forty you? Why so long? What do you love? Well, some of it’s that the work continues to need to be doing dahna but some of it is that you do. I think the old skills and you build a sense of capability. And you can see things happen that you’ve done or and this is what i would say is that every way the books that i write try a likely impossible soul try to connect people to a broader stream of people working for such for social justice that started way before any of us were born and is going to continue long after we die. And if we feel connected that stream, it can help carry us, and we can help carry others. Add to me that’s a lot of what keeps me doing it because it means that not only do i have a community that supports in the current time, but i have a community historical time, which i could see is supporting, and that makes you an awful lot of difference. This would be your fifth year. I believe we’re beginning your five. I think it’s been a good long run. I’m glad. Glad to have you back another year. That’s. Amazing. Tony and its great teo continue having our conversation. So thank you. All right, um, before we get into the path act, there is something that you alerted me to just happened yesterday. The irs had this proposal for acknowledging gif ts of two hundred fifty dollars, or more. And they have withdrawn the proposal. Can you can you get us up to date? Sure. Um, and so that’s. Ah ah, great new happening for the nonprofit sector. Although we have cem cem maybe controversial or dissenting about about that, we’ll get there. Go. Ahead. Okay. Object in your presentation, please. So let’s, start by saying what? What? What? The proposal wass and it was for providing an alternative for donors tio evidence that they actually have made a charitable contribution of two hundred fifty dollars, arm or under existing laws, donors are required to have a written receipt that contains certain information, including, you know what, the chick who the charity is, what amount of the contribution is, and importantly, there must be a statement on that receipt that says no goods or services were provided by the charity and return assuming that was the case. If donors don’t maintain that receipt, then they could get their deductions denied, even if they had actually made the contributions right. The time of getting that receipt, they must have that receipt in hand, or it must have been prepared before the donor files their tax return. It’s no good to do it after they’ve been audited and can’t produce that. So that was the original problem. So the irs said, well, you know, we should make up a rule that allows the charity tow, have some responsibility as well if they opto have it and it is really important which you’ve pointed out to me, said it is optional for the charity under this new rule, which ultimately was withdrawn. But the proposal was that the charity could file another information, return to the irs with the donor’s name, the amount of the contribution and the donor’s social security number, and that would be in lieu of providing a proper receipts the donor, and meeting those requirements of having a proper written receipt so that would evidence a charitable contribution to charity would take on the burden at its options, and you go about it there’s that the donor loses the receipt, or the charity didn’t issue the receipt with the right information about that no goods or services were provided to the charity. In return, it was still ok, everything was good. The donation was good because charity filed that information return with the irs, that evidence the contribution, that that the big dispute about that and why a lot of non-profit organizations, especially the big advocacy and national organisations got upset was because of the social security numbers that the non-profits would have to collect if they wanted to file that return, right? Ok, s o the need for the social security number makes sense because that’s the identifying part, may that’s the identifying the piece of data so it’s clear why it’s needed, and i just want to point out that this has been a problem just taking a little step back. It’s been a problem where donors and you and i have talked about this, so i make it clear for everybody. Donors have had their deductions denied because they don’t get or don’t keep well, i guess it’s more don’t get from the from the non-profits that contemporaneous acknowledgment that they need so this has been a problem area. And as you said, iris was trying to address it. You were, i’ll give you first shot we have is we didn’t really have a difference of opinion on the substance of this, that there was something around it that was troubling me. But you were very much opposed to this and a lot of others. You’re right. The big dick secure. Oops around the concern about that having that social security number metoo yeah. Thanks for letting me first time. Yeah. You know, the big problem is identity theft is a huge and growing problem both for individuals and the country itself. Identity theft is a huge problem, and the federal government has been i’m saying as a matter of policy, t people into agencies don’t collect social security numbers unless you absolutely have to, because there’s a danger in not adequately protecting them. So if non-profits opted to do this, they would have to make sure that they had adequate protections not to allow those social security numbers to get into other people’s hands. Andi so that was one of the big problems is could non-profit adequately protect the social security numbers if they didn’t really understand the rules regarding protection of what it’s called personally identifiable information that would allow people teo steal a person’s identity and there are a lot of laws around that and non-profits probably don’t know many of those laws and might accept the burden of taking on the ocean security numbers and filing that new information returned because they didn’t know about the laws, and that would create more liability for charities. That was the big problem. The other problem that comes up a scam artist would now be able to call donors. And ask for their social security numbers on behalf of a charity that they know that the donors are associating with so they might show up at a charity event. No, get to meet some people there, give them a call and ask for the social security numbers is part of the scam saying that they represent the charity, get that social security number and then commit identity, you know, theft that way as well. But those are a couple of the big, big problem that we had with this and, well, i’ll let you go next, and i have an additional tried t try to be civil about these things now in the place where we different was was not the substance i agree with your concerns and all the other agencies and and bloggers who are concerned about the substance of what opting in would mean my disagreement was why do we presume? It seemed like so many people were presuming that non-profits weren’t bright enough? Tow opt out of this, remember it’s totally optional. So why are we presuming that non-profits would opt in with great, vast unawareness of what it means to protect someone? Social security number versus presuming that the non-profits would say, you know that that opens up it’s up to some real potential liability and expenses of protection and software. So let us not opt in it’s a great point, and i don’t want to be little the expertise on dh ah skill that that non-profit leaders bring throughout the country, and certainly there are smart leaders throughout the sector, and the sector is the most trusted of all of the sectors by far and there’s reason for that. On the other hand, tony, last five years we’ve had more than six hundred thousand non-profit organisations lose their tax exemptions for failure to file with the irs. We’ve also had probably more than half of the organization’s they’ll tow register and states to engage in charitable solicitations in the state. Um, and, you know, part of that has to do just with a failure to understand some of the laws that may apply in the laws change from time to time, creating new requirements, which is case with the irs and smaller non-profits having to file all of a sudden, but also there had been a lack of really enforcement by different agencies. On non-profits because non-profits were trusted so much and a lot of scandals that have been coming up, you know, mostly because of the media attention that focused on a really pew of very isolated number. But very bad actors now has raised the enforcement level from from all the agencies. And because non-profits are not used to this level enforcement, it could easily oversee the neto to really adequately protect itself on legal compliance issues and that’s what we see a lot really well intentioned non-profits really bright leaders, but not being used to this level of enforcement. That’s our big concern with social security numbers. All right, let’s, go out for a break, gene, you and i’ll keep talking about this subject for just ah, a couple of minutes after the break, and then we got to move on to the path act. Um all right, so keep it civil. I do have to have something to say in response, but let’s, let’s, take a break and gene and i’ll be right back. So that was king burger, formerly ceo of charity navigator. Sam will have teo to take that one out of the rotation, but there are many others. Okay, jeanne, now you mentioned the way can’t devote a couple more minutes of this and we’ll get carried away. You mentioned, you know, the six hundred thousand or so now that lost their tax exempt status for failure to file three years in a row, even just a little return little postcard. But we know that a lot of those were defunct, you know, out of out of commission organizations. Not all but a lot of those were that were so they wouldn’t be soliciting. Continue. Teo, get donations anyway of any size. All right? And then you you mentioned charity registration that hits my sweet spot. Of course, we know that i do that part of my practices, keeping charity’s compliant in each state where they are soliciting donations on your right there’s a lot of lack of awareness. I say that a lot when i’m speaking in training and even for those who are aware there’s a lot of misunderstanding of it. So i i grant that i just ah, sametz dahna from, you know, it’s, just the seams, the constant presumption that charity’s won’t figure it out and do it correctly. Andi, just not up to opt in. Ah. Okay, i guess. You know, i’m pretty much just repeating myself. I don’t know anything else you want to. You want to add to that to that discussion? Well, i’ll just add that if donors really want to be sure that they’re going to get a deduction, they should really just ask the charities to make sure that they maintain permanently the receipt that was issued to them at the time. So if the donor loses at the charity will maintain it permanently, or at least for the number of years where they could go back, um, to make that deduction and that will have the same effect. Okay. Okay. But i mean, donors have responsibility too. You know, the charity sends you an acknowledgement letter or e mails it to you. You want to save it, you know. Ah, charity’s only do so much for tow. Hand hold their donors and then it becomes the donor’s. Fault. Really? Okay. Um, let’s move to the path act protecting americans against tax hike. I believe as a path and there’s ah, there’s stuff in there for charities. And most significantly, the ira rollover made permanent. Yeah, i mean it’s a really interesting act and is part of this greater bill that was signed into law but there’s three charitable giving provisions that were originally established this temporary laws and year by year they were extended for for the following year. But because congress would wait until, like, december of each year to make retroactive so effective for the previous night, that was so annoying, they would do it like november or october or something and give you, you know, thirty days or sixty days to market and promote it infinite into your your fourth quarter, but busiest time fund-raising plan. It was crazy. Yeah, and sometimes it what? There wasn’t enough time, particularly with the ira charitable roll over. So let’s talk about the diver roll over first, so that the provisions of the ira charitable roll over, which was first available in two thousand seven, allowed individuals age seventeen and a half older to donate up to one hundred thousand from their traditional or their roth iras latto eligible public charity. So no donor buy-in funds, no private foundations, no supporting work. And you didn’t have to count those distributions to charities as taxable income. Yes, very important. Yeah. And so that would be separate because i mean otherwise. At seventeen and a half, you have to start taking distribution from your iras and that’s typically taxable income to you. So instead of taking it and then making a gift of it, which you know you could get a terrible contribution from you just don’t include it in your income. It all right? So right. The nice thing about about that if you don’t get it, actually not included his income and take a charitable deduction because that would be double dipping, but but you don’t reflected in your gross income, which has a lot of different benefits that it that are even better than it’s been getting a charitable deductions so you don’t want to recognize it is income and then take it as a deduction. You want to make sure this is done right? Which means that the ira has to be made directly to the public charity and eggs. I can’t go through you first as an individual and then tow a public charity. Right there is there is an exception to that gene. If, ah, one of the years it was, it was available, there was ah, you know what they call them? Not private letter rulings, but attacks alert or something that if the charity writes the check payable to the sorry the ira custodian, your ira custodian writes the cheque payable to the charity and sends that to you and then you that you then convey that check to the charity that’s. Okay, that that does qualify as a as what? This is really a qualified charitable distributions. Technically, not a roll over, but i just want to say so that’s a possibility. And the other way, the other group of people that this could be really valuable for is non itemizers. Because if you’re not itemizing you, don’t you don’t earn a chat, you know, claim a charitable federal income tax deduction. You take the standard deduction, but you can benefit from this. Roll over and be a non itemizers. Still get the benefit? Yeah. That’s absolutely right. So most people don’t itemize their deductions, so getting a lower growth income on dh, lower taxable income, in effect is much, much better than nothing at all, which is what would happen if you’re a non itemizers and you make a gift to cherish and, of course, that’s a big benefit. Also another benefit of a lower growth income, which would happen by making the charitable roll over, is that your tax treatment of social security benefits is better and you have a lower medicare premium as well, right there they’re all based on taxable income thresholds, right? Exactly right? So the extent you can keep your taxable income lower, you’ll you’ll get you’ll have greater benefits in the store security area and and others too very true, and we don’t want to get too much into this, i think is an hour to go through them, but another big benefit of certain states charging income tax to their residents, the state income tax, but i don’t recognize a charitable contribution deduction for state income tax purposes, but they will take the lower growth income based on the charitable contribution exactly made from from the ira. So again, another benefit that you wouldn’t get if you took in the ira as income and then made a gift out, so this rollover provisions is really beneficial and has been seen tio for the years that it’s been around has been seen to be a very, very valuable tool for forgetting jean. We have to we have to move past that now because we promised people all three components of the path act and we only have about a minute and a half left, so i’m going to sort of summarize the first one for gifts of food inventory. Non si corporations can now can now deduct ah greater amount up to their basis there there cost plus fifty percent of the fair market value and for non si corpse that used to be limited to just your basis in that food inventory. If i even the playing field now so that small businesses could get the same benefit big businesses which are typical, see corporations so really nice to see that you can get not only a deduction of your coffee of the food that you’re donating, but half of the profits you would have made if you sold it and well. Seymour contributions from food to food banks because of that. Excellent. Okay. And you got to be concise on the third one. I’ll let you go. We just have a minute left. Okay? Landowners can deduct the value of a conservation easements land that they’re giving up their development rights over so that there’s preserve preservation natural resource is the old rule. Thirty percent of your adjusted gross income for up to six years could be deducted. The new rule. Fifty percent of your adjusted gross, thinkin and up to sixteen years. So really promoting land conservation. That’s why i let gene explain it. You see how much more articulately and concisely he does it than i do. Thank you, jean. Thanks. Study. Thanks so much, tony. Great to great to be back. And i’m glad to hear you had a good time with opportunity collaboration. I had a chance to go a few years back, did you? You were there a couple years ago. I wass oh, it’s ah, it’s really wonderful experience and it demeans it to call it a conference. It’s it’s, it’s definitely an unconference absolutely wonderful. I i didn’t know you had been there. Cool. All right. Are you thinking about going back? Twenty fifteen? Maybe a couple years down down the road. I would love to go back. Okay? It is very special all around poverty alleviation. So you’ve got some some scary scenarios for us for the halloween show and, uh, one of them is being sued. Yeah, absolutely. I’m probably one of the most terrifying things. For for a non-profit as we go through our list of ten non-profit nightmares getting sued, and particularly if it’s by an employee for something like discrimination or sexual harassment, wrongful termination, privacy violations that can just be terrifying and it’s just, uh, more common than people might think. Yeah, i get well, first of all, you have to credit unite non-profit nightmares. I didn’t think of that one. I thought of scary scenarios. I like non-profit nightmares better. Actually, i wish i wish you wish we had said that. All right, but we’ll stick with scary scenarios. Yeah, seeing your organization and it could even be you individually, right on the on the wrong side of ah, of the little v that stands for against it’s ah it’s. Very disconcerting. Yeah, absolutely. And it could be the nonprofit organization itself. Or it could be one of the non-profits leaders, manager, executive, director or even the board of directors who could all be serving in volunteer capacities, finding themselves on that other side of the law on dh there named as individuals. Right? So they have they individually have to come up with a defense happen and all the legal. Costs that are involved unless they have some sort of insurance that’s going to protect. Okay? And we talked about that. That would be the directors and officers insurance. Yes, you know? And if we’re talking about an employee lawsuit to make sure that directors and officers insurance has some sort of employment practices, liability protection involved, employment practices, liability protection, okay, so if you’re so that’s, what that’s to cover you if you’re sued for some kind of a discrimination in discrimination action? Yeah, discrimination, sexual harassment, wrongful termination, all those type of claims. Okay, way have talked about that. Do you know our directors and officers liability insurance? Very worthwhile having don’t you know, i’m not sure we did mention before i think it’s a majority of all employers that have face to claim sometime within the past five years, i think it’s a little less for non-profit employers with directors and officers insurance, but the average settlement again from some of the materials i’ve read between thirty and forty thousand dollars average defense costs, if you decide to go to court with it, could be about the same, and two thirds of the court cases favor the employees or the plaintiff against the non-profit or non-profit leaders so something really aware of and try to mitigate those risks? A majority are sued on that that’s on the corporate side, more than fifty percent. I’ve haven’t think overall employers over or some sort of claim, okay, past five years. And if you go to trial there’s a two thirds likelihood that the employer is going to lose is that right? Yeah. That’s what i’ve read, i don’t know it, and i think it varies amongst your jurisdiction. So i think california might be, for example, a little bit more employee friendly states like delaware, maybe a little bit more employer friendly. Okay. Okay, well, i trust that you’re reading reliable sources. So when you say through your reading, it’s reliable, i believe you. I believe the sources do that. You trust what else? We have something else we’ve talked about. Excess benefit transactions bother you? Yeah. I mean, that’s, that’s. Something really scary. And just for yeah, for people out there who might not know what that is. That’s basically just excessively paying one of your directors or officers or a family member of a director or officer. Or a business that’s controlled are owned by by one of your directors or officers. We just call them insiders, and when insiders get paid too much there, if they get caught, they’re going to have to return that excessive amount on pay a penalty tax, which could be twenty five percent of that access. So if you overpaid by ten thousand dollars, for example, the penalty would be twenty, five hundred. If you overpaid by one hundred thousand dollars, the penalty would be twenty five thousand. But the scarier thing is that if you don’t correct that within this given time period, basically, before you get assessment on an assessment from the irs, the penalty jumps up to two hundred percent of that excessive amount. So instead of twenty five hundred dollars penalty for a ten thousand dollar excessive payment, all of a sudden you have to return the ten thousand dollars and pay twenty thousand dollars in a penalty tax free iraq. So it could be a really, really scary thing and one of the major irs tools they have against preventing that type of self dealing type transaction to occur. Oh, that’s, the tool, the penalty, the penalty tax and it it really can be pretty harsh. The the other scary thing about about this is that the irs can actually even penalize the board members who approved that transaction, even if they didn’t benefit a benefit from it if they knew that transaction to be excessive, or they reasonably should have known that it was excessive and didn’t look into it. So even board members who don’t benefit from it can be hit with a penalty tax that would be equal to ten percent of the excessive amount. So they got a really careful, and we talked a little bit about this, but and there are procedures to help shift the burden of proof so that if the irs claims that you paid excessively, if you follow these procedures, which are it’s going to get me into jargon jail, you yeah, i know. But, you know, you were thinking over you’ll get yourself right out. You did last time. Do yeah. It’s called the rebuttable presumption of reasonable miss procedures and basically what it means is that there’s a presumption that the compensation was reasonable if you followed the steps and basically it’s just the interested party discloses the interest to the board. The board votes on it in the majority who are not interested in that transaction favorite. And they based that that approval on comparables that are that are reasonable comparables for that. And if you do that, then the irs has the burden of proof to prove that it was excessive. The irs usually doesn’t want to go through all of that, so they’re going to pick pick lower hanging fruit to go after in most okay. And the last time we talked about this was the march twenty second twenty thirteen show. If anybody wants to go back and we did talk a decent amount, i think about that that reasonable, the presumption of reasonableness on dh what what the cops should look like and things like that, okay, yeah, i mean, there’s, some really there’s, some serious penalties. Now, these are things that you see, right? Yeah, we see them fairly often if you if you make a payment toe one of your insiders and you don’t report it to the irs is a payment and they don’t report it to the irs. Sometimes people call them stipends and things and nobody reports it anywhere, and you get caught with that that’s automatically and access benefit transaction there. There doesn’t have to be any investigation. If that happened, you’re automatically hit with that penalty tax, so be very, very careful. All right, we have ah, we have a bunch more to go through. I’m taking on your non-profit nightmares because i like it better than my scary scenarios. What else you got for us? Nightmares or scary scenarios. My third choice is not withholding and cheering, paying payroll taxes. That is just a terrifying things. Look at gene’s got sound effects, some affection sound effect from san francisco about that because it’s, often done because of poor budgeting at organization, doesn’t have enough to pay payroll taxes and decided to defer payment and make sure that it’s making payroll in paying vendors on dh just ah, delaying or deferring the irs payments. But if you don’t pay payroll taxes, there are very, very harsh penalties and interest. Ah, and the scariest thing about that is directors could be personally liable, and i’ll repeat that again, volunteered directors could be personally liable for paying the taxes, the interests and the penalties that hadn’t been properly withheld in paid because the attorneys generals may think this isn’t she shouldn’t be paid with charitable resource is this is a deficiency or breach of fiduciary duty, and it really should be paid by the directors, so not withholding and paying payroll taxes really, really scary. Damn all right, and a lot of personal potential liability. This is the independent contractor versus employee, right? Well, that’s another way, there’s the first way. That is just not saying it because you’re paying other. Okay, okay, having an employee, but not paying. It. And then the other is misclassifying someone as an independent contractor to avoid paying it exactly right. You might not think you’re doing get to avoid pay. You might just think, well, i have a choice as an employer whether to classify a worker’s, an independent contractor, an employee. But of course, you don’t necessarily have that choice. Your guest. A few weeks ago, i had explained that’s, right? That was you eat huge tomb and he’s a c p a. And that show was on june sixth, and i have a guest here in the studio, jessica allen, who was a bookkeeper, and she’s nodding her head vigorously. Yes, to everything you’re saying. Because clearly, jessica sees this mischaracterization a lot or the failure to pay the taxes. Yes, both. Yes. Just kisses on both. Uh, whatever the june six show, we talked a lot about that with huge tomb. What else you got? So the next one i have is endorsing a political candidate for public office. And five a onesie. Three’s air definitely not allowed to do that. And the penalty can be revocation of their tax exempt status so they can lose their five. Twenty. Three status if they endorse a political candidate. Now, i think most organizations are savvy enough not to go in directly endorse a candidate or make a political contribution to a candidate, but they can also happen unintentionally just by inviting someone to speak at a charity event who might be an incumbent. I’m not giving them explicit instructions that she or he can’t campaign at the event or creating a legislative scorecard that compares candidates on a select number of issues important to the non-profit but it’s not done in a non partisan manner. Okay, so it can be done, but it has to be ah, has to be done equitably fairly across all the different opinions. Yeah, you’ll sometimes seemed the organizations like the legal world women voters come up with with legislative score cars and and they’re going to be a comprehensive look att just a broad array of legislation in how that candidates particular candidates foreign office may have voted in-kind such legislation, but they’re not going to just be selected to important issues to that non-profit their going to cross honore of areas and that’s that’s the way to do it nonpartisan if you just sort of select the things that are important to your organization, whether it be women’s rights or an environment or climate change, then you can really get in trouble that way. Okay, you can also get in trouble in social media, like on when someone posts on your facebook page, for instance, yeah, absolutely. So imagine somebody posting on your facebook page that you should vote for a political candidate for public office and you moderate the page. So you you really cleanse it of any defamatory statements or anything like that. But you don’t you leave those items up there? Well, that could be seen as tacitly endorsing the candidates enough, and you’re responsible for that for that facebook page, and you have that control. So by leaving it up, you expose yourself. Now what if you what if you don’t monitor your facebook page? Well, that makes that makes it a little bit more tricky. T now that we would just advise people to be careful of that anyway, because there’s all sorts of statements on that facebook page that might get you in trouble in other ways. All right, so that’s, why you leave them up? Okay? But it becomes more of an issue that you’d have to take a look at all the facts and circumstances if you don’t moderate it all. And there are few political endorsement from the general public, not from your staff and not from your volunteers, but from the general public. Okay, on dh, you can also get into trouble if someone makes a personal endorsement, right? And then it gets perceived to be organizational. Yeah, so you’ll see a lot of times, executives or sometimes board members endorse a political candidate, and their affiliation with the non-profit is going to be listed in that advertisement, or or endorsement. And if it’s done properly, there’s going to be some sort of disclaimer there that says that the organizational affiliation is written for ours, included just for identification purposes and in no way shows that the organization is also endorsing the candidate. But without that disclaimer, it might be seen specially if it’s an executive director or chair, the board that the organization self is improperly endorsing a political candidate again could jeopardize the organization’s exempt status. Okay, so so a simple disclaimer will cover us there. Yeah, but the, you know the non-profits not in control of that page. So you’ve got to make sure that your executives know if they’re going to allow their names and the organizational affiliations to be put onto a newspaper or some other advertisement for the benefit of a political candidate that they insist that that disclaimers there and the penalty for this is pretty severe. You mentioned loss of your five a onesie three status? Yeah. Is that all you want? You got to say more than. Yep. Come on. Well, i mean, how often does is how often does this happen either, yet either say more than yet, forgive me the living in that scary, that screaming which again? But, you know, so, you know, i mean handup okay, how often do you see that? That that sanction? Uh, you don’t see it very often because organizations are usually pretty good about it. And if you you know, if it happens once or twice tow an organization over a number of years, they might be a little lax about it. But if it combined with other things that show that you are really pushing it on endorsing political candidates, if not directly, indirectly then then you do see a few times i wouldn’t i wouldn’t say it’s a very common, but you do see a few times organisations lose their tax exempt status, and whenever it’s election season we see it more. I presume you would get a warning letter from the irs first depends how how bad your other activities are in terms of endorsing. So we talked about that legislative score card if you did that in a partisan matter, if you were allowing the particular candidate teo, get mohr you side of your organizational resource is than other candidates for the same office, and it showed that you were really acting in a partisan manner on a particular election, there could be a complaint from the other side and it’s the complaint that would likely launch the audit or investigation and that’s where you could be in danger of losing your tax. That man you get, the irs is investigating you, even if it’s not, we’re not even talking about a tax audit here. We’re talking about activity around election hearing i just that’s something i don’t think you want. I don’t think you want any government agency pouring through. Your emails and your social media pages, and i don’t know what else they would look at internal communications, maybe boardmember it’s oh, man, that sounds like a really nightmare. Talk about nightmare. Yeah, and on the other hand, tony, you’ve got to be careful not to tell any individual staff members, including your executive, that they can’t endorse political candidates because, of course, they have constitutional rights that they can as individuals endorse anybody they want, but they just can’t use that organizational affiliation without some sort of disclaimer. Have you ever been through an audit like this again? Not talking about tax, but whether it’s election hearing or anything else? Where the where the irs was questioning the activities of ah, of someone you were a client, you’re representing an organization? Not to the extent that they were threatening revocation, but we’ve certainly dealt with dad let’s examinations of political statement. Yeah, what is that? Like? What? How detailed do they get? Well, maybe that’s segways into my next nightmare and that’s having the i r s or the attorney general audit your organization regardless of whether they find anything writer or wrong it’s usually like when somebody surprises you and visit your home, or at least my home, and you haven’t had a chance to do any housekeeping that, you know, if you really dig in, teo, be probably confined all sorts of tiny little buy-in actions and one on a while you might be able to find more bigger violation that you don’t want to get out there, either to the irs or to the general public, including your donors and supporters, because they could be very embarrassing to the organization that going through an i r s or attorney general audit that, you know, if you’re lucky, it’s it’s, a correspondent, thought it, meaning that they’re just asking for paperwork. Okay, unlucky. They come into your office and they lived there basically for weeks and maybe even months or even longer. What are they doing? What are they doing? For weeks and months? They’re scouring all of your books. They’re interviewing employees to see whether you’ve done anything right or wrong right now they’re looking for something wrong. Yeah, and hopefully you’re telling them all good things so that you stay out of trouble, but if they’ve got reason, if they feel like they’ve got reason to investigate you, they could be in there for a very long time looking for for for that dirt. So you’ve got to be very, very cautious, damned if you’re going to if you get any sort of notice from the irs or your your state’s attorney general that they’re going to conduct some sort of audit on your organization, contact an attorney right away. You want to make sure that you’re prepared so you can get your house in order a little bit before they come. And if you don’t have the right policies in place to sort of mitigate what you know, poor responses they may have of your organisation, that that you get a chance to develop those policies during that interim period before they come. So at least you could say you’re proactively taking steps already even before they’ve noted anything. Do you have to give them office space? I mean, what if you tell them our officer’s? You know, it’s very crowded here, there’s just no desk space available for you. Can you keep them out that way? You know that we don’t have a phone or desk outlet stores, outlets, outlets are very scarce is that yeah, if you’re very very tiny than then, you know, there may not be a facility to sort of for them you’re right about that. I mean, keep them in the hallway or something, or in the elevator shaft or down in the lobby, maybe wherever it’s going to be, you’re not going to be a very pretty sight, but if you have your books in order and you’re giving them information and you’re very cooperative and you have a very active board with good minutes of board meetings that show proper due diligence that’s really going to help you in an audit, but if you’re careless, if you don’t have a lot of policies, if the board is really just rubber stamping decisions of the executive that’s going to be pretty evident quickly and an audit and that’s going to make him stay longer, well, that’s yeah, exactly, and we’ve talked about this before, too, but i’m glad we’re reiterating. Not following your own policies on dh you you cite a good example of governance policies when an organization says that they want to follow robert’s rules of order? Yeah, i mean, so you know, i often see by-laws of organizations that say we will follow our we must follow robert’s rules of order, which is, you know, six hundred to seven hundred pages that’s updated every once in a while every couple of years, and you’re you’re agreeing to incorporate all of that as rules of your organizations. And for most charities, that just doesn’t make any sense, and it creates all sorts of possibilities for a dissenting director or a dissenting member to find a procedural defect in those six hundred pages that you didn’t comply with and reverse or stop any action that the majority of the board might have wanted to take and thought they had taken all the center just to be hit with this, you’ve got a procedural defect, i’m questioning the action and going to reverse it, and maybe i’ll sue you if you if you say that you just disregarding my statement because our by-laws say we’ve gotta follow these rules. I see. Okay, so it’s as if it is incorporated into the by-laws okay, we just have a couple minutes left, and i know there’s other things we want to talk about, um, but we won’t be able to spend quite as much time the you could be you could be perceived as a private foundation, even though you’re a public charity. Yeah, most public charities become public cherries by passing this math tests, the most common test is a one third public support test that’s measured over a five year rolling period. And if you get enough small donations from the general public, you’ll meet that test. But one big private foundation grant, especially if you’re on the borderline of that one there’s support one big private foundation grant could tip you over into public chair, i mean, into private foundations status, and if that happens, most private foundations will no longer make grants to you because they only make grants to public charities and not the other private foundations. So it’s a very, very terrifying concern for any public charity that sitting on the borderline of their public support especially if it’s lower than one third and they’re going to get a big private foundation grant. Okay, way. Have to move on. What else? What’s another one napor ten delegating things to individuals you don’t know very well so maybe you let your volunteers run. From events for you, but you don’t do background checks on them, it’s kind of like, would you allow someone to care for your child without checking on their background? Probably not. I hope not. But would you allow volunteers to take care of other people’s children without checking on their background? Maybe in a kind of summer camp situation? Or do your employees, board members or other volunteers you know, have they been vetted and trained to be responsible for activities that you’ve told them to be responsible for? How how are these supervised? Okay, they embezzle or engage in fraudulent activities? Did anybody conduct a background check before they were put in a position to be able to do that? Those air, all terrifying concerns for me, there’s one around social media, which i am going to summarize for us, and we’ve talked about it and amy sample ward and i have talked about it too, which is making sure that you have a social media policy. And why don’t you give us our last one of the ten nightmare non-profit nightmares? Gene? Sure, signing a contract if you can’t live up to it, you know you get hit with breach of contact. You damage your reputation. Maybe you can’t make a required payment or you can’t deliver the promise. Good or service or you rep misrepresent facts that you said that were true inn representations and warranties in the contract that you didn’t carefully check. You do that you can really hurt your reputation. You would cancel it, cancel it if you had only thirty thirty participants but generosity siri’s puts a bunch of charities together, creates a community among their charity partners. They all raised money individually for each of their own causes. And they come together. And now there’s three hundred participants. So it’s going to be great fun and charity. Sorry, generosity. Siri’s also takes care of all the background work, like the medals and the licenses from the parks department and nypd and the sound system and the finish and start arches and the port a potties. All this stuff that you would have to deal with if you were running five k, they take care of it all. They have events coming up in new jersey. Miami in philadelphia, of course. So we we’ve bought probably more candy than is reasonable, but we’re very excited to have some trick or treaters come by. Excellent that’s. Right? This is your first halloween owning a home. Um okay, so you’ve you’ve come through the fund-raising technology trends study for us who this is ah, find accounting software dot com right in partnership with a f p a f p and find accounting software dot com and i want to thank adam bloom ner for bringing it to my attention. And then ah, you, you and i decided it would be be good. Good for discussion. Yeah. What did you find in there? It’s. Interesting. Well, i mean, i think there’s a lot that’s interesting in their andi i like the way that it is kind of broken out into different areas of interest. So one of the first pieces that i thought would be interesting to pull up because i think this is a big area of mis conception for organizations, and that is that, of course, that your organization is bigger. Well, then you’re just goingto automatically do better on that’s. Not necessarily the cases they found in their report. Focus on fund-raising, but also something we see at antenen our research just generally about technology. And and organizational effectiveness simply having a bigger budget as an organization does not have any correlation to you doing better to doing better work to being more effective. Yeah, just a good tone to start with that even if you are really small organization, it doesn’t mean you can’t be, you know, increasing your your fund-raising revenue year every year, you know, just like the bigger organization, yeah, it was very uplifting, your right to see those they had a bar chart to see small, midsize and large organizations all pretty much equivalent in terms of fund-raising fund-raising revenue growth. Yeah, exactly. And you see the same thing i mean, ultimately, i think it, you know, not necessarily a so just sit back and relax we’ll you know, just because you’re small, you’re probably doing better, but at least releases you from feeling like you don’t have any hope of of doing better because you’re small, but of course, you need to be paying attention to what is going to help you be affective and what’s going to help you be, you know, pretty savvy and your fund-raising i saw that on ly twelve percent of organization cited standing out from others as a fund-raising challenge. And so i think that’s related, you know, there are very few people are seeing that as a problem getting getting their message clearly heard, right, which is charging for small i mean, yeah, i definitely thought that was interesting because i feel like that is something that gets talked about a lot, you know, there’s there’s certainly plenty of fund-raising blog’s or, you know, tips and tricks for your fund-raising where it all focuses on really trying to share your unique message and, you know, show how you’re different from other organizations on dh for very few people, you know, only twelve percent said that was an issue, maybe that’s because they think they’re doing really well or leaving it because they haven’t thought to try and address that. Okay, yeah. Could be okay. Yes way do hear that a lot that, you know, how do i stand out? And you and i have talked about hundreds of strategies and tactics for making yourself unique to your to your constituents. Yeah. What else? What else did you see in there? Well, i’m kind of on that same lens. I thought that it was interesting that they found that many of the survey respondents did not cite technology as their biggest issue, but many of their biggest issues that they sighted. We’re somewhat related to communications on dh when i think i struck me about that, is that that it almost assumed or implied that technology wasn’t a part of those kind of communication issues? And i think it very much is it? If you have, for example, you know, a database that’s helping you track if someone has ah, you know, opened different email messages, even if they haven’t donated you can get a better sense for how to communicate with them, you know? You’re getting them to open the message, but they’re just not taking action, you know, i think there that’s just one example, but there’s so much that technology can do to help you understand how your communication is working and or not working, you know, and what to try next, you know, technology isn’t just this database that’s it’s over here by itself, you know, it’s really kind of underpinning all of those different communication pieces, whether it’s, your actual messages you’re sending out or your communications plan. Or figuring out, you know which messages works. And we call this on dh the survey, those two communications issues, i think of them two as relationship issues because they they’re talking about things in there, like deepening relationship. These are things that were questions deepening relationships, um, converting interest into donations on getting larger donations. I think of those as you know, this, i guess it’s anonymous, but i think of it all as under the rubric of relationship building, definitely on again, you know, i think there’s this tendency to kind of think of of it is two different buckets that are totally isolated from each other there’s relationship building and fund-raising which is having that gala, everybody being in the same room, you know, or taking that person out to lunch and learning about what they’re interested and and why they’re maybe wanting to support your organization and then almost as if all of that has to be totally separate there’s this idea connections not even relationships, but just connections online, people that are, you know, on your facebook page or on your email list, and i think we really miss miss the opportunity to tie those. Together, people that were at that gala event that also are on our email list and we should be, you know, creating messages that recognize they were at the gala and not just that they’re a random person on the email list, you know, really connecting those two worlds so that we are creating deeper relationships because it’s not sustainable, to think every week you’re taking that person out to lunch, but if you think about, you know, a couple times a year taking them out and then every week having something relevant, teo, email them about mean that make a man could make a huge impact in that individual feeling like they’re connected to your work and that’s deeply related to the stuff you and i talk about what we say multi-channel you know, multi-channel strategies you have, you have your real life strategies, the online and then multiple, you know, multiple within both whether it’s lunch, gala parlour events you know face-to-face live or whether it’s email you’re blogged, twitter, facebook, whatever is appropriate, you know, online and yes, we’ve said this so many times, but it’s always critical, you know, and it’s it’s it’s hard for some. Organization to implement, they don’t think that way, right? But i think it’s, because organizations that don’t think that way are thinking about it as an organizational, um, process there thinking we have this message and were sending it out over here. Some other staff person is, you know, planning the annual gala, some totally other staff person is the one who probably go, you know, maybe the executive director who’s going out meeting with people and we don’t ever stop to create a better process inside the organization that reflects those people are humans, they are individuals, their experience with us is not divided up by which department we work in their experience with us as an organization. So if we aren’t connected across across the staff, you know, if we’re saying that the person working on the gala just kind of keeps their own list and is doing their own job and everyone that comes to that it’s totally separate, well, we’re never going to create a very good relationship with all those people because we’re never going to recognize oh, there also on our email list or a couple of them actually did go out to lunch. With our executive director, you know, they’re gonna have this really stop and start relationship with the organization. Yeah, very narrow. Well, yes, when the organisation looks narrowly and myopically. Right? Right. Okay, well put now, there was good news about technology in the study as well. Definitely. I was really excited to see some of the findings they highlighted specifically to the technology tools you know, the survey respondents were using first super great indicator was that theorems were ah, leading tool that organizations were using a sierra meaning york your database and what what’s happy about that? What? What makes me really excited is that that says to me, organization are moving away from this kind of not ideal, but also, i think, set up not out of intention, but just out of happenstance and that many organizations have you no totally separate email list management, a totally separate database for people that are coming to their events and registering to participate totally separate database, you know, for people who donated and seen organizations invest in having one central database where all of that data can live doesn’t just i mean, it’s probably less crazy making in-kind the organization, because everyone has all of these different, you know, databases in place, but it also means that the organization their position to have those those relevant messages to be able to communicate about what people have really done. If all that data is in one place, you can actually create an email that says, hey, tony, thank you for coming to the gala last week and here’s what we like you too dio, you know, because you’re able to pull from the database and know who came, who donated in the past, who attended a separate event, you know, and really use that data to your advantage to make message is much more relevant. So i think that a really great indicator, okay? And there was some as well, uplifting news about use of analytics. Oh, doesn’t i mean, i was actually surprised that it had even been added to the survey because i feel like it’s so often overlooked, really excited that, you know, for them putting the survey together, they included that as an option. And so many people said they really are using web analytics in there in their fund-raising on and that’s not because somehow in the analytics your, you know, getting donations from people but that’s where you’re going to see, you know which pages on the web site are people just dropping off? Which pages could we optimize better? You know which pages air people actually clicking on and staying on a long time? You know what content there is that where we have stories about our impact, you know, you could just learn so much about how people are using or ultimately not using the website. You can make a lot of informed decisions about which content to upstate you know, you probably don’t need to update your entire website, but using analytics you can figure out maybe there’s a couple web forms, maybe there’s a couple sign up pages that really you’re just losing so many people? What did you just focus on updating those and making it really easy and see a really huge difference? We got to go away for a couple minutes when we returned. Of course, i mean, i’m going to keep talking about treats in tech trends as we look at the twenty fourteen fund-raising technology trends study, stay with us. I don’t know what it means if we potentially have three letter government agencies listening to your show. What have you been doing? That’s. What? They’re that’s what? They’re listening to find out. I mean, i’m certainly not going to reveal it. They have to gonna have to do their own due diligence. They’re on their way round there. They’re on their own with their unlimited budgets and staff. Um, let’s. See? Okay, so let’s, continue. Wait. So we know that we love wave analytics, you were you were impressed that that was part of the survey, and we’ve talked about you know, we’ve covered a lot of this web analytics critical like you’re saying, you don’t know how you’re you don’t know how to improve if you don’t know how you’re doing and you don’t know how you’re doing if you don’t measure exactly, and i think that, um, maybe testing so, you know, having to pages that are essentially the same page, but something is slightly different, and testing that on your web site is is most fun but is also most valuable when you do that. Maybe testing on, for example, donation form pages or call to action pages where you’re saying here’s our story we want you to give, click on that donate button and being able to test in real time. Which button to use which photo to use which story to use on dh? There are a lot of free tools that we’ve even talked about on the show before to help you do that. A b test name you don’t have to be technical, but you congest use these tools. To help test those pages in real time and then say great, the one with the blue sticker is working let’s use that. So checking out tools like optimized li i mean, there’s just there’s a lot of different free three, maybe testing tools, but i think they can make a really big difference. And i mean it’s october thirty first. Probably every listener has already started or is about to launch their end of your fund-raising campaigns, so get ready to you don’t have to do it ahead of time. Do it well that while that campaign is live, test out which page is working and, you know, depending on how much traffic you have, you could spend a knauer you could spend a day and already see a difference between the two auctions and put that better page into use okay? And and related to these tools, um, i saw that eighty percent of the survey respondents recognized tex value for their fund-raising but on ly a third felt that they have all the tech tools that they need. Exactly. That was disappoint that part. The second part was disappointing. Yeah, and i think there was kind of ah, ah related finding to that people the data at least suggested for those organizations who said that their fund-raising was effective or was really effective, that they were also using twice as many software programs or technology tools as those who said that their software was ineffective. Oh, it’s. So i think that i think that the takeaway or the reminder, at least from my experience, isn’t that that means used every tool you can come across. I mean, you don’t want to be using so many tools, but now your time is spent trying to use these tools, i’m not fund-raising but i think it is a reminder that just having the database is probably not going toe give you everything you need, you know, or just relying on web analytics to figure out what works well, you’re not you’re never going to test every message in that way, you know? So recognizing that you’re going to need, you know, kind of ah can fall or so of different tools that are being used purposefully and strategically to help you craft that full campaign, the full message, etcetera, but that you can’t rely on a single tool and you also don’t want to go so far that you’re using so many you spin and you know, you’re just keeping all those spinning plates going let’s move from tools, tio two different channels there was there was a lot of about multi-channel which we’ve talked about, and we only have about only about two minutes left. Great, i think what didn’t surprise me at all was that the leading channel, with eighty three percent of respondents saying they used that channel, is in person events meeting? I mean, we all know fund-raising you’ve got to connect with people off line and what was really exciting is that the second, you know, eighty one percent right behind that was our website. I feel like so many organizations forget that the website is central to your work because they think, well, facebook is where the people are, twitter is where the people are, and we kind of forget about our website, but that is our central backbone of every ask every campaign you know, all of our information and regardless of age, bracket of age demographic majority of people say they visit a non-profits website before they decided they’re going to give so keeping that website as your your real face of the organization, i think it’s critical, we have just like, a minute left or so so i want everyone to know that the survey is called twenty fourteen fund-raising technology trends study and you’ll find it at find accounting software dot com and i mean, let me give you the last minute to ah, explain how and ten might help people with their non-profit technology issues excellent. Happy to be with your audience today. Thank you very much. I’m glad you are too, and i i think it’s safe for me to speak for them to them, for them that that they’re glad you’re here too. Tell me about this cfr lots of lots of people are cf ari’s certified fund-raising executive, but you’re in advanced certified fund-raising executive right, and they’ve been certified fund-raising executive i used to be able to say i was one of fewer than one hundred, but just recently, with unless couple of months, we accepted number ninety nine and number one hundred into the fold on and it’s really an honor to be counted among the cfr ese it’s. A long, grueling process but i think it’s well worth it in the end. It’s it’s a process that you go through your really dedicated to this profession and a hundred of us at least are on. Did you have to be invited? Teo too do the work to get the a before your c f r ee. Well, the processes that you have to be a c f ar e already. Andi, i have been in the profession ten years or more. And then what makes us a little bit different from the cfr e to see if our reprocesses you take an exam and the review committee looks at your exam and make sure there’s no ethical violations on your record and then you’re automatically approved with e f r ee it’s really a four step process? It’s the application itself, and then you do take a written exam, which is obviously a little bit harder than the cfr e exam. And then you put together a portfolio showing your work and at least two a p f r ee piers will review that portfolio and then the third part of the fourth part of the process is an aural exam. Where again, about three, of your peers will take you through. About a three hour process where you give your oral answers to questions that are thrown at you by this group. So pretty grueling process. Ok, i happen to be a u a c f r ee ultra advanced there’s there’s. Only one of us, though. Come on, that that’s pretty cool. I guess i’m gonna have to try to get to be number two in that group. I don’t think you’re qualified. I’m sorry. Probably not. It’s the next level up, but it sze very secretive. Yeah, like the masons for, like free masons. Usc fr ee. Okay, so i have to learn a secret handshake that well, if you’re qualified. But i don’t believe that you are. I’m sorry. Okay? We’re talking about corporate giving. And specifically, i think small companies. But but before we get into big versus small there’s lots of forms of corporate giving, right, but it’s way beyond just just money. Yes, yes, there is, you know? And i think sometimes we kind of forget the many ways that corporations do contribute to the non-profit world besides e-giving cash, which most of us are familiar with cash or grant, there is in-kind there’s corporate. Volunteer programs, which can be really magnificent for a lot of organizations. And some corporations like to do sponsorship. Not so much of sponsorship of events, but other sponsorship may be sponsoring one of your program. Something like that. So there’s a whole variety of pockets you can delve into. Yeah. There’s also giving of inventory, right? Gif ts in-kind right. Right. Okay. And i’ve had some clients really be very successful with gifts. In-kind i could also tell you a bunch of horror stories about gifts and well, okay, we’ll hold the heart stories, but just, uh well, maybe, but we know that just want to set the ground work. We know there’s lots of different ways that we could be approaching cos on dh. You also want people to think broadly about the kinds of companies they approach. You will identify a lot of under the radar businesses, right? Right. And i think a lot of times we tend to always look at those big companies in our community whether their banks are hi tech companies. But there’s, every community has a couple companies that everybody thinks someone it’s like. Okay, how can we raise some money from the business sector and they all tend to think of a big company. I called the willie sutton theory that’s, probably because i spent a lot of years in banking before i was involved in the nonprofit world. But, you know, they one day it’s really sudden white, he robbed banks and he said, because that’s, where the money is and sometimes that’s the impression that we get some of those big companies about us for all the money is i have no live near las vegas and in our community, it’s, let’s go after the big casinos because, look, i have all this money, and we just kind of roll up with our little plastic cup and asked him to fill it with money, and it doesn’t always work that easy, right? So let’s, identify some of the the under under the radars and you like your name, like pest control movers, landscapers, right? Small, small companies that are often get overlooked by the way that that willie sutton story according to wikipedia, he didn’t really say that. That’s a pocketful. You know, i just heard that recently to that it was actually a reporter who described that statement. To him, but by still called the willie sutton xero describe doing me whether he said it or not, i don’t think we’ll take away your cfr designation because i hope not it’s, not that that’s, not really an ethical breach. It’s, just a little fib a little fairy town not doesn’t reach the eye to the level of ethical oversight, i guess in the next edition of the book will have to say that statement was described to willie said it or not, ok, let’s, talk about some of that well, how to get started with this. I mean, i would think now we have lots of different size companies on we have lots of different ways that we can approach various sized companies, so that creates a lot of variables. Should we be starting with what our goals are? Starting with gold is always important looking at how many companies, realistically or in your community, how many you think you might be able to reach and that’s going to be based a lot on how many staff and or volunteers you have to reach out to that business community, and i really stressed the word volunteers because sometimes the staff people think they have to do this all by themselves, and i have found that the best way to reach the corporate sector is tohave appear make that peer-to-peer solicitation. So if you have volunteers on your board, your development committee, a special committee that set up just to do a corporate annual appeal, you be able to use what i call the five to one rule, and this is a pretty common thing and fund-raising that no one volunteer is to make more than five calls when you’re talking about going out, personally visiting with someone and that’s what we’re talking about because personal solicitation is really the only way to get to the corporate community. I find direct mail doesn’t work, and most of the time, phone calls don’t work because the decision makers don’t take phone calls or open mail, okay, you through a lot of stare in terms of volunteers and how to approach and whether events versus one on one is best. So we’re going to unpack that we’re going to take a break for a couple minutes when we come back. Ok, linda, listen, kowski let’s unpack some of that stuff that you let us into let’s begin with how to approach the companies. You you suggest in in your book a cultivation event? Yes, i think cultivation events are a great way to get to know the business leaders and have them get to know you. Lots of times. The organizations think they just go knock on the door or send a letter and suddenly they’re going to raise all this money from the business sector, but these businesses a run by people, we have to remember that, and people need to get to know your organization before they’re going to support it. So i’ve had some very successful cultivation events were business leaders are invited in, always hosted by another business leader not hosted by your executive director or someone within your organization. And i think that’s one of the keys to success here is who does the invite king? I remember one working with the homeless shelter group, and they had keep business leader in their community, invite other business leaders in they thought they’d get about twenty, some people. They sent out seventy five invitations, and just about everybody they invited showed up mainly because of the host so that’s a big teo successful cultivation event. You profile that example in the book and then go a little further and talk about how how moved the breakfast attendees were yes, what we did was we started this it’s seven thirty in the morning and on the east coast, especially of the united states, i think you know, if you want to get business. Leaders have it first thing in the morning because they want to come in, get out of there and get back to their office before the day gets away from them. So we had a seven thirty eight, fifty eight, fifteen very brief agenda. We just kind of explained a little bit about what the shelter was homeless shelter, what they did, but the figment really sold these people was a tour which was led by a former guest of the shelter who was now gainfully employed at his own apartment. And when he took these business leaders around and showed them the shelter and said ice asleep over there in the corner, it really hit home that this organization was doing something valuable for its community, that it was turning people’s lives around, then it was making the business environment better. So of course they were really eager to support the organization, and some of them wanted to write out checks immediately, even though we had said that we’re not asking you for money at this event, and we actually didn’t take their money. We said, no, we’re going to come back to you later, but you know, we just want you to see the shelter and see what we’re doing here, and it really made a huge impact on that community talking about business leaders, companies what’s your experience with professional practices like lawyers, maybe dentists, orthodontists i think that’s another category i usually often call it business and professional again. I think the best way to get to doctors is through another doctor in the best way to get the lawyers is through another lawyer. These are all really busy professional people, and they don’t often have a lot of time, but they will make time to speak with a calling. So the key is getting your volunteers who can open the doors to these people and that’s, how you’re going to be successful and what’s our next step then after this cultivation event, which moves people i love the idea of hosting it on site that’s, that’s just so brilliant instead of having it at a restaurant or a hotel or something having if you have a facility where you can tour people around, i just think that’s a very is you cited that could be really moving what’s the next step after the after the event the events over now, okay, after the event, then one of the things that i suggest people is that they hold an annual corporate appeal involving volunteers, and what we did, for example, with that shelter is the volunteers who were so excited about it. A zay said some of them wanted to write out a check. A lot of them said, hey, when you’re ready to go out and talk to people about contributing to the shelter, count me in. I’m ready. Teo, help you with this project. So we developed a list of volunteers based on that cultivation breakfast and those volunteers all set. Okay, i’ll see these five people. I’ll see those five people. And we organized a really well honed annual corporate appeal and there’s a whole chapter in my book outlined how you go about doing that, it would probably be take up the rest of your show. And maybe the next three shows teo, tell everyone how it worked. But the key is involving volunteers letting them choose who they want to go see and seeing their peers. Because that’s, what gets you in the door and that’s what’s going to get you? The money. You need a long run. I would like people to know, too, that the book is very detailed in terms of how to go about these steps that has a planning timeline and a sample invitation and a questionnaire for after the after the event. So there’s there’s. A lot of good advice in the book and detailed advice. And linda, i think, did you wantto offer a listener discount? Tio? Okay, usually i like to see, that could be non-profit radio or tony rocks or something, but linda, think about linda twenty fourteen books we’ll work, it’ll get you the fifteen percent. Of course, if used tony rocks, you get thirty five percent. But buy-in but not this. Not this time around. All right, so we’re talking about volunteers. Volunteers are critical to the success of this. Do we need to train these volunteers? Oh, absolutely. Even though volunteers maybe radio i’ve done this a zillion times you want to i sort hesitate to use the word training sometimes because nobody thinks they need training, but we always had a kickoff celebration where we invited all the volunteers to come in. Somebody in the organization made a compelling case for support, and when i worked in the university, for example, we would have a student come in and talk about the fact that they were not there on scholarship, they wouldn’t be able to afford the university. So we have somebody that makes a compelling story for why we’re doing this, why we’re raising money and then you do need to give people some basic guidelines about, you know, how to make the call and how to fill out the pledge forms and when to make a report back to you. So it is there’s some work involved in it, but i think it really can be very, very helpful if you can get these volunteers in twos and excited just again remember that these are business people, they don’t want toe meat for three hours at a time, they want to come in, probably first thing in the morning and have a meeting that’s over within about an hour to an hour and a half and make it is easiest possible and keep your timeline short don’t give people a six month time frame, they’re only making five calls, and they should be able to do that and about a six week time frame. You recommend a five call limit because i presume you don’t want people to be overwhelmed by a list of twenty or twenty five names or something exactly what happens is something you all we have, some over enthusiastic volunteers payable. I know this person and i know that person and give me fifteen or twenty calls, and what happens is they never make any calls because fifteen or twenty just too intimidating. They pull out their list and they say i’ll work on that tomorrow. I don’t have time to think about it today, so if you give them five it’s a very manageable number now, i wouldn’t say we never she sometimes we have somebody who only makes three and that’s fine. If they’re three quality calls, sometimes we have somebody who could do six or seven, but i try to keep it to five to one because that’s a pretty realistic number and it’s proven to work. What if the person comes back and says i’ve done my five tonight? Can i have five? Five more were ready to do what? Okay, yeah, so you will give them or after their dahna naralo e-giving five to start with, okay. After they’ve done their initial, they can they can come back with more. Okay. And and what are they asking in these calls? Well, they’re there, then, presenting a case for support, which shows that you have various ways that businesses can support you. They can give a gift. They can restrict a gift, maybe, for example, to scholarships for school. Something like that, they could give a gift in-kind i’ve had some organizations that have been ableto build about a third of their building because they had everything donated from landscaping to excavation to furniture, toe windows to cement so you could get gifts. In-kind you can get cash, you can get other volunteer support, but primarily we’re looking at things in effect, the bottom line, so we’re looking at cash and give in-kind mostly all right, why did you tell one of your gift in-kind disaster stories? If if it’s not too long, well, i could give you a couple of them just one one took one pick the most of that, i think is probably the most interesting one because i live in the state of nevada, i had someone offer, give this wasn’t really a gift. In-kind it was a cash gift, but they had a real struggle was trying to determine if they should take a gift in-kind from a brothel because here, it’s illegal business in many counties so that they’re not offering gift in-kind are they okay with things that would really be quite interesting? Yeah, i mean, but gives in-kind i’ve had gifts of land offered which needed a half. A million dollars worth of oil remediation, that’s a gift in-kind you probably don’t want to take well, yeah, because you don’t want to have contaminated soil. Tohave teo remediated, but you’re glossing over the brothel example, but i we’re going to linger on this for a couple moments. I thought you might find that one interesting. Yeah, well, you were right because i go to the lowest common denominator. You know, mike sense of humor’s generally basin lowbrow in the gutter. Andi, i’m proud of that. S o have have you had clients offered gifts from from brothels? I have and some have taken them, and some haven’t, because they said they’re not doing anything illegal in that particular county, but others don’t take them because they feel like it flaunts the mission of their organization. But the pto gifts in-kind and unusual gifts like that are you have tohave gift acceptance policies in place that say what you’re going to accept and what you’re not going to accept. Interesting. Right there is the issue is do we want to take money from organizations that are contrary to what are companies that are contrary to what our beliefs are? What our mission is about that could apply for, well, really could apply in just about any circumstances, but i’m thinking particularly of, like domestic violence, possibly or health related charities, certainly any of the faith based religious charities and that’s where, you know, you really need to be careful about what you’re going to accept and the things that volunteers need to have before they’re asked to go out, make calls, they need to know what kind of gifts you’re going to accept. What other kind of support does the organization have to give two volunteers that are making these five calls? Well, i think they need to have a staff that’s going to support these volunteers because volunteers are going to i guarantee there’s a volunteer they’re going to call you say, oh, i’m supposed to make this call today, but i lost my my information that i was supposed to hand out can you send me another fact sheet, or can you send me another pledge card? I don’t have one and i have an appointment this afternoon, those of the kind of things that staff need to be there to support people and i think most importantly, what you need to give here’s a program that’s worthy of support. If they feel in food that your program is really doing a lot of good in the community, they will be proud to be part of your team. That’s going out asking for money so that to me is the most important thing that you need to provide volunteers. How about the chair of this annual business appeal? How do we how do we make sure we have the right chair person? Well, that’s a really important that because you wanna have a chair person that is well respected, well known in the community, can command respect is enthusiastic themselves. I had one gentleman wants to volunteer for a volunteer firefighters group, and he showed up at a meeting with and this is a top ceo in the county. He showed up with a fire helmet and red suspenders because he was so into what this would do it. He didn’t even take the time to change that e one to make his commitment well known that he supported the volunteer firefighters. He thought they were doing fantastic work, which they were, and his enthusiasm was contagious. Everybody else got excited about the campaign because he was excited about it. Outstanding. Okay, um, we have just a couple minutes left. Linda, tell me what it is that you love about the work that you do and you’ve been doing for for thirty years. I think what i really love the most is being able to help people fulfill their missions and so many of the things that, you know, i can’t just take off and run to africa and help dig wells or do a lot of different things, but i can help people raise the money to do those wonderful things. That’s what i enjoy about it the most. Because when charities come together, they can do when people come together should say into charities they khun do enormously good work that individuals can’t do that government and corporations aren’t suited for right? Your it’s, your excitement, enthusiasm i it’s exudes the audience and the and the guests. We can’t help it. Okay, we’re talking about committees this week. You are concerned that whether where you’re questioning whether there should even be bored committees right aboard doesn’t necessarily have tohave committees. I’m just questioning the concept of whether every non-profit should have committees, and particularly for small non-profits with small boards of directors, committee’s may make sense, and sometimes they may not make sense, but there are a lot of kind of misconceptions about whether you have tohave committees. Okay. And what what is what governs? Whether you, whether you have to or not basically, i mean, you know, the usefulness of a committee is where aboard has got a lot to two, got a lot of governance responsibilities, and they may want to delegate some of those off two smaller groups that might be able to address the civic issues with more focused expert teeth. And, you know, it may be particularly helpful to be able to recruit persons outside of the board, to participate in committees as well. So those are good reasons for having committees but it’s not a good reason to have a committee. If you largely just bring people in without much direction, they sit around talking, you know, come up with a few pieces of advice and share it with the board, who sort of disregard that advice and decides on their own what to do. And a lot of committee members feel very disempowered and not very productive feel that it’s not a very productive use of their time to participate on committees, and they largely become ineffective. Yes. So there are clearly issues of efficiency on dh or inefficiency. Let’s, get some some terms down. We could have standing committees. We could have ad hoc committees. We can have a task force. Can you help explain these? Sure. Well, typically, you know, standing committee, the committee that has a perpetual existence until you know the board or some body decides that that committee doesn’t need to exist anymore, but talking generally perpetually existence and ad hoc committee is usually organized to address a specific task on dh at hot committees are often referred to his task force taskforce is although i don’t really see the difference between the two. They have defined life spans, and usually, when the assigned task is completed or can’t be furthered anymore that’s when when that committee saw what would be an example of something that an ad hoc committee would would be working on, they might work on the capital campaign or ah, particular event, for example. Okay, i saw some examples of leadership transition to if they’re if we’re in search of a new ceo. Yeah, absolutely. That’s. Another great example. Okay, it was just a good but now it’s just it’s. Just a good one on important. Well, thank you. Okay. Let’s, see, eso now weaken also have board committees and advisory committees. And you mentioned having people outside the board on committees. So can you help us understand this? This distinction? Sure. You know, i think it’s a really common misconception that you can have somebody that’s not on the board served on a board committee. The first distinction is that a board committee is made up of on ly board members and nobody else you can have other committees that are not bored committees. And they could be delegated with authority to andi, those other committees, non board committees all refer them to right now, khun b, composed of both directors and bond directors or simply just non directors. People from the outside and why i actually prefer the term non board committee toe advisory committee is that these committees could be delegated with management authority and they can have significant authority. Um, but the difference between the board committee and these non board committees is that only a board committee can be delegated toe act with all of the power of the board and there’s certain limitations to that authority as well. But boredom it ease khun act. In place of the board, in many, many circumstances where as a non board committee could not actually do that for pete’s sake. Okay, so non board committees, though, can be can be authorized by the board. Teo, do some narrow function or something, right, but not but not be delegated all the responsibilities of the board is that is that is that correct? Yeah, so they can actually have substantial authority, but they can’t act in place of the board. So where aboard action is necessary. Often times it will say a board or a board committee can take this ac action, but a non board committee would not be able to do that. What a non board committee might be able to do, though, is tio make decisions on fund-raising or on policy advocacy or program decisions. They might be able to approve a lease or something else. The board may wantto ratify those actions later and board oversight over committee actions is really unimportant. Part of governance, too, okay, and all the authority given a committee, whether it’s, a board committee or non board. And i guess even whether it’s standing or ad hoc all is given. From the full board. Is that right? Yeah. Generally that’s, right? So so the board of directors is going to delegate certain authority to to these committees, and they’re going to want to get some sort of report back from what these committees, if they’ve been given any sort of authority to take action so that the board khun khun, monitor and provide oversight over those committee actions. Now, i think the standing committees aren’t those aren’t those fairly common. Yeah, i think it’s it’s very common for organizations dafs standing committees, although, you know, i might venture a pretty aggressive guess and say that a lot of standing committee’s it’s not the majority of standing committees are pretty useless. Uh, okay, to be careful for a lot of smaller organizations, a lot of standing committees are again not very useful in acting in place of the board, and they might be good for giving advice. But then there there might not be a need for perpetual existence on dh they’re off. They’re obviously gonna be many, many exceptions to that, i would say generally, boards have to be very careful about having standing committees that are not active in that air not tasked with specific duties that feels very, very empowered to carry out those duties and provide recommendations to the board or take actions in place of the board if they’re bored committees or take management actions if there’d been delegated without authority. Yeah, otherwise, if these committees become ineffective and boardmember start to feel their time is being wasted, you’ve got a big donor relations problem among your most committed or formerly most committed volunteers. Yeah, absolutely. That’s. I mean, if you’re a boardmember tony, would you like to sit around at a committee meeting for two hours and then report back to the board and the board just listens to the report and then just move on carrying on businesses normal without taking any action on those? You know that reporter recommendations let’s, let’s, talk about the executive committee on di. We pulled listeners and you helped pole gene before the show. Thank you very much. One of the questions was do you have an executive committee of your board? And ninety percent looks like maybe a little more than ninety percent said yes, and and the remainder said no? Nobody said not sure. So thes executive committees, at least for listeners of non-profit radio, are very common. But there’s pros and cons yeah, absolutely on dh. So, yes, i think executive committees, they’re probably the most common form of committee. Um and they may make a lot of sense for a larger organizations, especially if they’ve got boards that have difficulty meeting on a relatively frequent basis and executive committee is a good way to continue to provide oversight over the organization in between board meetings and the executive committee may be ableto act in place of the board. Teo, you know, past what bank resolutions to open up a bank account and and do some of the sort of ministerial duties that that boards need to do some time. So for those reasons, executive committee’s could be very valuable the danger or the primary danger. I think with executive committee that if you over delegate authority to the executive committee, you could empower the board. So the executive committee could be the core leadership group that sort of takes hold of the organization and just creates a power discrepancy between the executive committee, board members and all the other board members so that the executive committee pushes through its agenda and takes all the action’s necessary to push through its agenda, leaving the rest of the board disempowered and feeling inactive and not very helpful to the organization at all. And just as he said before, with no disengaging your your your biggest donors which typically include includes many of your board members, you could do the same thing by giving too much power to an executive committee than dis enchanting those boardmember donors who are not part of that committee, where do you draw the light? Well, not where? How do you draw the line about? If we are going to have an executive committee, how much authority that committee should have versus the full board or other committees who decides this well, it should be the board and that’s where way commonly don’t see anything defined in terms of limiting the executive committee’s authority and that’s, one of the sources of problems often by-laws say that the executive committee just can act in place of the board in between board things and that’s the limit of the authority that’s been given to the executive committee, so they’ve got almost blanket authority to do almost anything in between board meetings and that’s, not a good governance structure so e-giving specific tasks or limiting executive committee, too, performing only certain tasks and maybe acting maura’s a reporting body to the rest of the board. Maybe the way too structured for most organizations, there are some organizations where the executive committee needs to be given a little bit more authority, but the board has gotta be ableto exercise oversight over those executive committee actions as well. So getting reports back at the next board meeting ratifying perhaps the most important executive committee actions taken after vetting the supporting information is really part of a board studio. If you were listening the first half of the show, you would know that the ufc ari, is something that i hold, which is an ultra advanced certified fund-raising executive. I hold it. And now, in the first half of the show, i bestowed it upon guest linda lacey kowski. But i have not bestowed upon anyone else but that’s. Okay, gene, i’m sure you were prepping for the show. I know you were. I know you were busy thinking about our our committee conned fab conversation. So there are people who, well, simone, anyway, she feels very strongly about there should not be executive committee’s at all. I think it’s ah, great discussion toe have come for some boards. But, yeah, i think that’s, really just being provocative and stimulating, whether executive committee’s should really be granted with broad authority. I think for the most part, especially with larger boards and boards that may be spread throughout the state or throughout the country. Executive committee’s still can be very useful. Okay? But it’s a worthwhile discussion to have and your point earlier was that it’s the full board that should be deciding this, not just the chair and the and the ceo, right? And it should be in a good note that only the board can create a board committee and and executive committee should be aboard committees. Executive committee should be a committee that’s composed of only board members. And if that that’s the case again, the board is the only body that can create an executive committee to chair the executive director they can’t commit. Create the committee themselves. Okay, how about staff support for board committees? What should that look like? Well, first reference, there’s. A great article in blue avocado that came out recently on staffing committees. And i recommend that all your listeners staff support of committees is is just so crucial it really important to make sure that the committees are well equipped with the information they need? I had to carry on their duties and connected to what the organization is actually doing on the ground, and not just in theory and in documents so providing that support understanding for it, for the staff. That better involved in providing support to the committee’s, understanding why the committee members are there and are looking to help the organization and understanding how to best communicate information to them and facilitate the way for the community committees toe act including, you know, figuring out how to get the information to them in the right form, within the right amount of time, in advance of a meeting or an action that needs to be taken, providing them with the right facilities and, you know, even providing the right food and drinks that that’s the incentive to bring the committee together, all of those things could be tremendously helpful. We talked earlier about the advisory committees on another poll question for listeners was, do you have advisory committee or committees? And about sixty three percent said they do and the remainder well, about thirty, thirty percent said no, and then the rest weren’t weren’t quite sure so, like two thirds do have advisory committees let’s explore this little deeper than they could be valuable, you suggested it, but let’s go deeper in bringing outside expertise into the into the into the organization and supporting the board. Yeah, and i can’t emphasize enough that i think an advisory committee and non board i’m sorry, non board, i meant non board, i know you, you prefer non board. I screwed that up. Non-cash well and advisory committee khun b ok, for the bombs were committees that are delegated with management power, so if they’re going to strictly have advisory privileges, i like advisory committee. I don’t particularly like advisory board because board suggests that their board members with fiduciary duties, if you have a fiduciary duties, you have potential exposure to personal liabilities for failing toe live up to those duties, and we’ve talked about that. Yeah, so the great thing about being an advisory committee members if it’s truly advisory, you don’t have any fiduciary duty, and that makes it much easier to recruit individuals who might not have the time or it might not have the desire. Teo sort of meet all of the fiduciary duties of being a boardmember but really like the organization which case, you know, you can recruit them on an advisory committee. That committee might just meet once every six months, or it might meet even less than that, or it might just be a body of people who executive director can phone, you know, phone every once in a while just to bounce ideas off of on get they’re a pain in perspective, so in that way you could just really widen your resource pool, forgetting expertise, piri instant perspective that might be missing from the board. And i just think it’s such a valuable tool that many organizations are able t utilize, but a lot of organizations are really not taking advantage of the ability to do that. I think that’s a shame if they’re not not utilizing that that very valuable cool it sounds very valuable for the, uh well, here we go. Very valuable. Yes, it sounds really useful for the for the ceo have that that list of advisors that he or she can call and pick their brains and, you know, sort of be even in, like, an off the record discussion because we’re not in a board meeting and we’re not talking to someone who has the fiduciary duties. Yeah, think it’s, so valuable to be ableto have that for for the executive director and the executive director might have know their own sort of clos closely. Held advisory body and the board might actually have its own advisory body as well on dh it’s, nice for the board to be able to participate and network amongst themselves and, you know, boards have fund-raising responsibilities, as you often discuss with some of your guests. But acting is ambassadors to the organization and bringing in not just financial support but expertise to the organization and introducing them to people who might be interested. It can also result in future donors as well. And so i think advisory committees are just fabulous ways toe teo grow the resources of an organisation just about a minute or so left jean i think i saw on your blogged link to a site called board cafe. Yeah? Are you familiar with that? Is that that? I presume? I’m pretty sure it was your board. Your your block. So it’s. Not a resource that you’d recommend. Yeah, i think board cafe was adventure initially launched by compass point non-profits services, based in san francisco. It’s, a management support organization that’s recognized widely is is one of the best in the country on dh. It may have been taken over by the the online magazine blue avocado i mentioned earlier, i’m not sure that board kapin still exist.
